Background
1. The Aplicant filed an RTI Application on 18.3.2010 with the PIO, Northern Railway, NWR, HQ, Jaipur seeking the following information.
a. Which date received P.S.No 11450?
b. Which date closed to 40 Point Roster Register for the post of OSI/'P' branch? c. Which date opened to Post based roster register as per P.S. No.11450 of OS1 of 'P' Branch and Also Which date verified by concerned officer of RP cell to both Roster register for the point of closing & opening ? What is reservation position of ST at the time of closing & opening of both Roaster Register?
d. Smt.Krishna Setia was promoted as OSI w.e.f. 01.11.1995 on the basis of 40 Point Roaster Register or Post based Roster, Please clarify by DYCMM/NR? e. Promotion of OSI/'P' branch is continued on the basis of 40 Point Roster, Please date mentioned ?
f. What action is taken on My application dated 2.4.2007, 31.8.2007, 4.1.2008, 21.8.2008, 13.11.2009, 18.1.2010 and 8.3.2010 in which requested to DYCMM/NR for promotion as OSI w.e.f. 1.11.1995?
g. Please provide details of action taken on My above cited 07 application's wise with support of document's like all noting's and order's passed by any authority in this regard (Promotion) h. List of OSI of "P" Branch since established "P" Branch at Shakurbasti.
2. The RTI application was transferred on 22.3.2010 to the SPO, Northern Railway, Shakurbasti, Delhi. The PIO replied on 7.5.2010 providing point wise information. Not satisfied with the reply the Applicant filed his first appeal on 10.5.2010. On still not receiving any reply, the Applicant filed his 2nd appeal before the Commission on 6.7.2010 requesting the Commission to issue order for provide information against points 2 to 7 including supporting documents i.e.N.P/order passed by authority as indicated in his application dated 18.3.2010.
Decision
3. The Commission on review of the information provided, noted that the available information against point nos.2 to 5 had already been provided on 7.5.2010 and that information against point no. 6&& had been furnished vide letter dated 5.3.2010. In response to the Commission's query as to why there was delay in furnishing information, the Respondent explained that a delay of a period of 18 days, had occurred since they had to verify whether the RTI fee had been deposited or not from PIO, NR HQS Baroda House, before providing the information. The Commission accepted the explanation as a reasonable cause for delay.
4. The appeal is accordingly disposed of.
