THE COURT MADE THE FOLLOWING:


                             ORDER

Learned counsel for the petitioner has filed a memo seeking withdrawal of the petition. The memo reads as under:

"It is submitted that the petitioner in the above case has filed the present petition seeking bail under Sec.439 Cr.P.C. but it appears that the petitioner got released on default bail under Sec.167 Cr.P.C. As such, the present petition does not survive for consideration and thus, the same may have to be dismissed as having become infructuous.
Wherefore, it is prayed that this Hon'ble Court be pleased to dismiss the above petition as 'not pressed/having become infructuous', in the interest of justice and equity."
