Since all these writ petitions involve common facts and question of law, these are being decided together.

The facts in brief are that to improve the nutritional status of children from 0 - 6 years, pregnant women and lactating mothers, the Central Government floated the National Nutrition Mission (Poshan Abhiyan) (for brevity-`NNM'). The State of Rajasthan, being implementing agency, invited bids for procurement of manpower through placement agency vide NIT dated 12.6.2018. An agreement dated 28.8.2018 was entered into in between the official respondents and the respondent no.4, the successful bidder, a private entity. Under the terms of agreement, the respondent no.4 hired services of the petitioners on contract and issued them appointment order (collectively placed as Annexure-4) in the months of September/October, 2018. The term of the agreement, which was to expire on 29.8.2019, was extended from time to time and ultimately upto 27.8.2020/entry of new placement agency, whichever earlier. The life of the NNM which earlier was upto March, 2021, has also been extended. The official respondents issued fresh NIT for procurement of manpower services (Downloaded on 25/11/2021 at 09:31:32 PM) (62 of 96) [CW-3540/2020] whereupon, M/s. Leader Star Security Limited stood lowest bidder. An agreement dated 24.7.2020 was entered into in between the official respondents and the new service provider. The petitioners were communicated by the official respondents not to attend the office post 27.8.2020 i.e. commensurate with the expiry of the agreement dated 28.8.2018. However, it is not in dispute that services of the petitioners are continuing with the new placement agency. In the aforesaid circumstances, it was prayed in the petitions that the respondents may be restrained from discontinuing the petitioner's services under the NNM till its life, they may further be restrained from replacing them with another set of contractual employees, they may be permitted to continue in service irrespective of the change of placement agency and that the official respondents be directed to engage the petitioners directly under the NNM with direct payment of salary rather than engaging them through a placement agency.

The official respondents in their reply submitted that they have issued the NIT for procurement of manpower under the provisions of Rajasthan Transparency in Public Procurement Act, 2012 (for short-the RTPP Act') and the initial period of the agreement dated 18.8.2018 was extended for a further period of one year i.e. till 28.8.2020/engagement of new placement agency, whichever earlier, as per the terms of the agreement and the provisions of the RTPP Act. It was submitted that there was no privity of contract between the petitioners and the official respondents. They prayed for dismissal of the writ petition.

Learned counsel for the petitioners submitted that for effective implementation of the NNM, the Central Government has (Downloaded on 25/11/2021 at 09:31:32 PM) (63 of 96) [CW-3540/2020] constituted various committees from national level upto block level and has issued operative guidelines chalking out modus operandi for its implementation vide order dated 26.2.2018. Drawing attention of this Court towards the guidelines so laid down, Shri Jain submitted that the official respondents are the competent authority to implement the scheme and are authorised to take all necessary steps in this regard. He submitted that the guidelines reflect that the State Government has deep and pervasive control in respect to the implementation of the scheme and hence, the placement agency has been brought into picture only to create an artificial barrier in between the principal employer and the petitioners. He submitted that in any case, even hiring of their services through placement agency does not absolve the official respondents from their responsibility towards the petitioners who are instrumental in effective implementation of the scheme.

Inviting attention of this Court towards the letter dated 5.10.2018 issued by the respondent no.2, Director Integrated Child Development Department, learned counsel submitted that since the appointment orders of the petitioners were subject to confirmation by the official respondents, they should be treated as the employees of the State Government and their services deserves to be continued irrespective of change of placement agency till life of the scheme.

Learned counsel submitted that they are otherwise also entitled to continue in service till the scheme lasts in view of settled legal principle that a contractual employee cannot be replaced by another contractual employee. In this regard, Shri Jain relied upon the judgements of Hon'ble the Supreme Court of India (Downloaded on 25/11/2021 at 09:31:32 PM) (64 of 96) [CW-3540/2020] in case of Mohd. Abdul Kadir & Anr. vs. DGP, Assam & Ors.-(2009) 6 SCC 611 and coordinate bench judgements of this Court in Jagdish Prasad Yadav & Ors. vs. State of Raj. & Ors., S.B. Civil Writ Petition No.12237/2012 dated 11.12.2015 and Shiv Charan Meena vs. State of Rajasthan & Ors., S.B. Civil Writ Petition No.7637/2015 dated 9.5.2017.

Relying on the judgements of Hon'be Apex Court in the case of Dr. Janet Jeyapaul vs. SRM University & Ors.-(2015) 16 SCC 530, learned counsel submitted that since the private respondent, the placement agency, is engaged in discharging public duties by providing necessary manpower for implementation of the Central Government scheme, it would also fall under the definition of "other authority" under Article 12 of the Constitution of India and would be amenable to the jurisdiction of this Court.

Shri M.S. Singhvi, learned Advocate General, drawing attention of this Court towards the salient features of NNM, submitted that its main goal is to achieve improvement in nutritional status of children from 0 - 6 years, pregnant women and lactating mothers in a time bound manner in three years beginning from 2017-2018. He submitted that 50% of its funding is from government sources and rest 50% is through International Bank for Reconstruction and Development or other Multilateral Development Banks. He submitted that government budgetary support would be in the ratio of 60:40 between Centre and States. Learned Advocate General submitted that since, in view of the laud object of the scheme and its limited budget, the State Government, the implementing agency, could not afford to part with a major portion of the fund towards salary for manpower, it took a (Downloaded on 25/11/2021 at 09:31:32 PM) (65 of 96) [CW-3540/2020] conscious policy decision to have manpower through placement agency under the RTPP Act. Referring to the various clauses under the agreement dated 28.8.2018 as also the appointment orders, the learned Advocate General submitted that the petitioners are contractual employees of the placement agency and have no privity of contract with the State Government. He submitted that it is the placement agency which has exclusive administrative/disciplinary control over the petitioners. Shri Singhvi submitted that the placement agency has hired the petitioners without inviting applications from open market in violation of mandate of Articles 14/16 of the Constitution of India and hence, the principle that one set of contractual employees cannot be replaced by another set of contractual employees, is not attracted. In support of his submissions, he relied upon the judgements in the cases of Bhuvnesh Gautam & Ors. vs. Principal Secretary, Department of Skill Entrepreneurship and Employment & Ors., S.B. Civil Writ Petition No.8896/2016 dated 28.02.2019, Vishal Verma vs. Principal Secretary, Department of Skill Entrepreneurship and Employment & Ors., D.B. Special Appeal (Writ) No.669/2019, Dharmendra Singh & Ors. vs. State & Anr., 2015(3) RLW 2221 (Raj.) and division bench judgement of this Court in Dharmendra Singh & Ors. vs. State of Rajasthan & Ors., D.B. Civil Special Appeal (Writ) No.97/2015 dated 11.12.2016.

He submitted that this Court, in its writ jurisdiction, would not like to dictate the terms of agreement executed in between the official respondents and the private service provider so as to incorporate a condition therein that the services of petitioners would not be discontinued with the change of placement agency (Downloaded on 25/11/2021 at 09:31:32 PM) (66 of 96) [CW-3540/2020] and no new placement agency entering into a fresh agreement under the terms of NIT, can be bound down to hire services of the manpower provided by the erstwhile placement agency. Learned Advocate General submitted that since the petitioners have failed to establish any legal right or any corresponding legal duty of the official respondents to continue them in service irrespective of change of placement agency, hence, no such mandamus can be issued. He, in this regard, relied on the judgements of the Supreme Court in Bihar Eastern Gangetic Fishermen Cooperative Society Ltd. vs. Sipahi Singh & Ors., reported in (1977) 4 SCC 145 and Director of Settlements, Andhra Pradesh & Ors. vs. M.R. Apparao & Ors.- (2002) 4 SCC 638.

Shri Singhvi advancing his arguments further, submitted that in absence of any prayer to declare their engagement through placement agency as illegal, it does not lie in the petitioners' mouth to contend that they may be treated as the employees of the State Government with an obligation of the official respondents to pay them salary directly.

Shri Singhvi, argued that the petitioners have failed to demonstrate that their services have been hired by the respondent- department through service provider as a camouflage and, therefore, they cannot be treated as the employees of the State Government. Learned Advocate General submitted that in any case, the petitioners are required to approach an industrial adjudicator to establish that the contractor has been created as an intermediary or is operating as a subterfuge and as a matter of fact, the petitioners should be reckoned as employees of the principal employer i.e. the official respondents and such an (Downloaded on 25/11/2021 at 09:31:32 PM) (67 of 96) [CW-3540/2020] exercise cannot be undertaken by this Court in writ jurisdiction. He, in this regard, relied on the judgement of the Supreme Court in Steel Authority of India Ltd. & Ors. vs. National Union Water Front Workers & Ors.-(2001) 7 SCC 1 and A.P. SRTC & Ors. vs. G. Srinivas Reddy & Ors.-(2006) 3 SCC 674.

Shri Singhvi submitted that it is a settled legal proposition that matters relating to creation, abolition of post, prescribing the source/mode of recruitment and qualification etc. fall within the exclusive domain of the employer in which the courts have the least role to play. He relied upon judgement in case of Union of India vs. Pushpa Rani & Ors.-(2008) 9 SCC 242 in this regard. He, therefore, prayed for dismissal of the writ petition.

Shri Ashwani Jaiman, learned counsel for the private respondent submitted that though, under the agreement dated 24.7.2020 executed in between it and the official respondents, it was under no obligation to continue with the services of the petitioners, the contractual employees of the erstwhile placement agency; but, still, taking a humanitarian approach, it is continuing services of all the petitioners. He submitted that petitioners have accepted the terms and conditions offered for employment by the erstwhile placement agency with eyes open without any demur and hence, now, they cannot be permitted to turn around and question the same on the principle of doctrine of estoppel/election which is based on the principle that a party cannot after taking advantage under an order be heard to say that part of it is invalid and ask to set it aside. In this regard, he relied upon the judgement of Hon'ble Apex Court in the case of State of Punjab and Ors. vs. Dhanjit Singh Sandhu-(2014) 15 SCC 144. Shri Jaiman submitted that the (Downloaded on 25/11/2021 at 09:31:32 PM) (68 of 96) [CW-3540/2020] petitioners were given appointment without undergoing any recruitment process and hence, they are not entitled for any relief.

Heard the learned counsel for the parties and perused the record.

There is no quarrel with the general and broad proposition that a contractual employee cannot be replaced by another contractual employee but, the question herein is whether it has applicability in the singular fact of these cases wherein the petitioners have been hired by the placement agency, admittedly, without following any due procedure of recruitment or any recruitment procedure which can be reckoned as fair and/or transparent. In the much celebrated judgement of the Hon'ble Supreme Court of India in case of State of Haryana & Ors. vs. Piara Singh & Ors.-(1992) 4 SCC 118, it was held as under:

"46. Secondly, an ad hoc or temporary employee should not be replaced by another ad hoc or temporary employee; he must be replaced only by a regularly selected employee. This is necessary to avoid arbitrary action on the part of the appointing authority."

However, in the same breath, it was further held that :

"47. Thirdly, even where an ad hoc or temporary employment is necessitated on account of the exigencies of administration, he should ordinarily be drawn from the employment exchange unless it cannot brook delay in which case the pressing cause must be stated on the file. If no candidate is available or is not sponsored by the employment exchange, some appropriate method consistent with the requirements of Article 16 should be followed. In other words, there must be a notice published in the appropriate manner calling for applications and all those who apply in response thereto should be considered fairly."

(69 of 96) [CW-3540/2020] Indisputably, the petitioners have not set up a case that their services were hired by the respondent no.4, the placement agency by inviting applications from open market.
A coordinate bench of this Court has, in Bhuvnesh Gautam & Ors. vs. Principal Secretary, Department of Skill Entrepreneurship and Employment & Ors., S.B. Civil Writ Petition No.8896/2016 and other connected writ petitions vide its judgement dated 28.02.2019, held as under:
"20. Several cases have come up before this court of contractual employees praying that they should not be replaced by another set of contractual employees.
21. While such a principle has been laid down to be correct, still the question arises whether original employment on contract has been given in accordance with law or not i.e. whether the selection process was adopted in consonance with transparency and fair play before making appointments on contract basis. The appointments made through placement agency resulted in candidates having been appointed by back door method who have been appointed without undergoing any selection. The administration and functioning of any State entity, if allowed to be handed by such employees, would result in causing administrative chaos and non-governance as they have no accountability. Sooner or later we may end up every appointment being made on contract basis and encourage situation where the people may start bidding for the posts in the State Government or its instrumentalities which would result in nothing but encouragement of corruption. Such concept would demolish the very basis of our Indian Constitution system.
22. In the present case, the petitioners were appointed through back door method by the respondents No.3 and 4 and were working with the respondent No.2 which is an instrumentality of the State. Their appointment was for a fixed term basis and the contract was exclusively with a private firm i.e. respondents no.3 and 4. If the petitioners are allowed to continue, it would be encouraging back door method of appointment. While their term of appointment (Downloaded on 25/11/2021 at 09:31:32 PM) (70 of 96) [CW-3540/2020] was ending in July, 2016, they have already continued upto now without facing any selection. Thus, the petitioners cannot be granted relief of continuing in employment."

The intra court appeal, D.B. Special Appeal (Writ) No.16696/2019, preferred by one of the employee-petitioner Vishal Verma against the aforesaid judgement did not find favour with the division bench and came to be dismissed vide judgement dated 12.7.2019.

In case of Sanjeev Kumar Sharma vs. The Advocate General, Government of Rajasthan, S.B. Civil Writ Petition No.1251/2007, wherein the question was right of the petitioner to continue him on contractual employment co-extensive with his post, a coordinate bench of this Court vide its judgement dated 18.05.2016, while dismissing the writ petition, held as under:

"25. From the materials available on record, and the terms and conditions of the appointment of the petitioner on contract basis; it is more than clear that it was an appointment on purely contractual basis till the post is filled by regular appointment or till further orders, with further stipulation that the petitioner shall not be treated as an employee of the State of Rajasthan in any manner whatsoever. But for fixed salary of Rs. 2,000/- per month, he was not entitled to any perquisites or allowance including bonus, periodical increments, DA, PF etc. The offer of contractual appointment also contemplated termination of the engagement at any time without any notice.
26. xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx Furthermore, no procedure whatsoever was followed while extending the offer of appointment in favour of petitioner. Thus, the appointment was clearly illegal.
27. A three Judges bench of the Hon'ble Supreme Court in the case of Renu & ors. Vs. District & Sessions Judge, Tis (Downloaded on 25/11/2021 at 09:31:32 PM) (71 of 96) [CW-3540/2020] Hazari & Anr., Civil Appeal No. 979/2014 decided on 12.2.2014, held thus:-
8. As Article 14 is an integral part of our system, each and every state action is to be tested on the touchstone of equality. Any appointment made in violation of mandate of Articles 14 and 16 of the Constitution is not only irregular but also illegal and cannot be sustained in view of the judgments rendered by this Court in Delhi Development Horticulture Employees' Union v. Delhi Administration, Delhi and Ors. MANU/SC/0156/1992 :
AIR 1992 SC 789; State of Haryana and Ors. v. Piara Singh and Ors. etc. MANU/SC/0417/1992 : AIR 1992 SC 2130; Prabhat Kumar Sharma and Ors. v. State of U.P. and Ors. MANU/SC/0664/1996 : AIR 1996 SC 2638; J.A.S. Inter College, Khurja, U.P. and Ors. v. State of U.P. and Ors. MANU/SC/0932/1996 : AIR 1996 SC 3420; M.P. Housing Board and Anr. v. Manoj Shrivastava MANU/SC/8059/2006 : AIR 2006 SC 3499; M.P. State Agro Industries Development Corporation Ltd. and Anr. v. S.C. Pandey MANU/SC/1037/2006 : (2006) 2 SCC 716; and State of Madhya Pradesh and Ors. v. Ku. Sandhya Tomar and Anr. MANU/SC/1138/2012 : JT 2013 (9) SC 139.

9. In Excise Superintendent Malkapatnam, Krishna District, A.P. v. K.B.N. Visweshwara Rao and Ors. MANU/SC/0980/1996 : (1996) 6 SCC 216, a larger Bench of this Court reconsidered its earlier judgment in Union of India and Ors. v. N. Hargopal and Ors. MANU/SC/0057/1987 : AIR 1987 SC 1227, wherein it had been held that insistence of requisition through employment exchanges advances rather than restricts the rights guaranteed by Articles 14 and 16 of the Constitution. However, due to the possibility of non sponsoring of names by the employment exchange, this Court held that any appointment even on temporary or ad hoc basis without inviting application is in violation of (Downloaded on 25/11/2021 at 09:31:32 PM) (72 of 96) [CW-3540/2020] the said provisions of the Constitution and even if the names of candidates are requisitioned from Employment Exchange, in addition thereto, it is mandatory on the part of the employer to invite applications from all eligible candidates from open market as merely calling the names from the Employment Exchange does not meet the requirement of the said Articles of the Constitution. The Court further observed:

In addition, the appropriate department.....should call for the names by publication in the newspapers having wider circulation and also display on their office notice ...and employment news bulletins; and then consider the case of all candidates who have applied. If this procedure is adopted, fair play would be sub served. The equality of opportunity in the matter of employment would be available to all eligible candidates.
(Emphasis added) (See also: Arun Tewari and Ors. v. Zila Mansavi Shikshak Sangh and Ors. MANU/SC/0926/1998 : AIR 1998 SC 331; and Kishore K. Pati v. Distt. Inspector of Schools, Midnapur and Ors. : (2000) 9 SCC 405).
12. The principles to be adopted in the matter of public appointments have been formulated by this Court in M.P. State Coop. Bank Ltd., Bhopal v. Nanuram Yadav and Ors.

MANU/SC/3761/2007 : (2007) 8 SCC 264 as under:

(1) The appointments made without following the appropriate procedure under the rules/government circulars and without advertisement or inviting applications from the open market would amount to breach of Articles 14 and 16 of the Constitution of India.
(2) xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx (3) xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx (Downloaded on 25/11/2021 at 09:31:32 PM) (73 of 96) [CW-3540/2020] (4) Those who come by back-door should go through that door.

13. A similar view has been reiterated by the Constitution Bench of this Court in Secretary, State of Karnataka and Ors. v. Umadevi and Ors. MANU/SC/1918/2006 : AIR 2006 SC 1806, observing that any appointment made in violation of the Statutory Rules as also in violation of Articles 14 and 16 of the Constitution would be a nullity. "Adherence to Articles 14 and 16 of the Constitution is a must in the process of public employment".

14. In State of Orissa and Anr. v. Mamata Mohanty MANU/SC/0110/2011 : (2011) 3 SCC 436, this Court dealt with the constitutional principle of providing equality of opportunity to all which mandatorily requires that vacancy must be notified in advance meaning thereby that information of the recruitment must be disseminated in a reasonable manner in public domain ensuring maximum participation of all eligible candidates; thereby the right of equal opportunity is effectuated. The Court held as under:

Therefore, it is a settled legal proposition that no person can be appointed even on a temporary or ad hoc basis without inviting applications from all eligible candidates. If any appointment is made by merely inviting names from the employment exchange or putting a note on the notice board, etc. that will not meet the requirement of Articles 14 and 16 of the Constitution. Such a course violates the mandates of Articles 14 and 16 of the Constitution of India as it deprives the candidates who are eligible for the post, from being considered. A person employed in violation of these provisions is not entitled to any relief including salary. For a valid and legal appointment mandatory compliance with the said constitutional requirement is to be fulfilled. The equality clause enshrined in Article 16 requires that every such appointment be made by an open advertisement as to enable all eligible persons to compete on merit.

17. xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx In State of U.P. and Ors. v. U.P. State Law Officers Association and Ors. MANU/SC/1583/1994 : AIR 1994 SC 1654, this Court while dealing with the back-door entries in public appointment observed as under:
"xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx xxxxx From the inception some engagements and contracts may be the product of the operation of the spoils system. There need be no legal anxiety to save them.
(Emphasis added)"

37. Thus, by now it is well settled that in an appointment made in violation of recruitment rules, the same cannot be treated to be regular. From the materials on record, it is evident that the appointment to the post of LDC, involved herein, was to be made on contractual basis from open market. There was no advertisement made inviting application from eligible candidates for consideration of their candidature for appointment on contractual basis. The appointment of the petitioner was dehors the procedure much less a back door entry. Whether any active part is played by the petitioner or not has nothing to do with the appointment which was made contrary to the directions made by the State Government to appoint LDC on contract basis from open market in accordance with the provisions of Act of 1970.

39. For the reasons and discussions hereinabove, the writ application lacks in merit and therefore, deserves to be dismissed."

A coordinate bench of this Court has, in case of Dharmendra Singh & Ors. vs. State of Raj. & Anr.-2015 (3) RLW 2221 (Raj.), while dealing with an identical situation wherein the petitioners were appointed on contract basis through a placement agency and were claiming not to be replaced by another set of contractual employees/placement agency, held as under: (Downloaded on 25/11/2021 at 09:31:32 PM)

(75 of 96) [CW-3540/2020] "13. In the instant case, the petitioners were never employed by the respondent-college, but were employed by the respondent-placement agency which agency was engaged by the respondent-college on contractual basis. Hence it could not be said that the petitioners were appointed by the respondent-college on contractual basis. That apart, even as per the aforesaid legal position, the persons employed on contractual basis would not have any right over the posts and their services would come to an end with the end of the contract. The Constitutional Bench of the Apex Court in the said decision of the Secretary, State of Karnataka vs. Uma Devi (supra) had also while considering the earlier judgments observed inter alia that the appointments made without following the due process or the rules did not confer any right on the appointees and the courts cannot direct their absorption or regularisation, or re-engagement or making them permanent, and that any decision running counter to the said decision (i.e. of Uma Devi by the Constitutional Bench) would stand denuded of their status as precedents. In view of the specific mandate given by the Apex Court in the said decision of Uma Devi, the petitioners cannot seek relief to continue them or to treat them as the direct employees of the respondent-college, relying upon the decisions of the Single Bench of this court.

14. The engagement of the petitioners by the placement agency do not confer any right on the petitioners much less the right to be treated as the direct employees of the respondent-college. It is also very pertinent to note that the respondent M/s. Rajendra Sharma who had engaged the petitioners and who was the earlier placement agency engaged by the respondent-college has also refused to continue the contract with the respondent-college, and under the circumstances, the respondent-college has no alternative but to engage the new placement agency by way of stopgap arrangement till the regular posts are filled up by the regular recruitment process. It cannot be gainsaid that the (Downloaded on 25/11/2021 at 09:31:32 PM) (76 of 96) [CW-3540/2020] respondent-college being Government College should fill up the posts by regular employment after following the due process of law, and it should not continue to engage the placement agencies on contractual basis, nonetheless the petitioners cannot as a matter of right demand their continuation or permanence of employment with the respondent-college as sought in the present petitions. Though much reliance has been placed by the petitioners on the decision of the Single Bench of this court in the case of Sunil Kumar vs. State of Raj. (supra), whereby the court had compelled the placement agency that might be engaged by the respondent-college, to continue the petitioners, the said decision loses its significance in view of the legal position settled by the Apex Court in case of Secretary, State of Karnataka vs. Uma Devi and Ors. (supra) and other decisions. The Apex Court in case of Gridco Ltd. and Anr. vs. Sadananda Doloi and Ors. (supra) has also reiterated that the termination of contractual employment in accordance with the terms of the contract is permissible and the employee could not claim any protection against such termination, even when one of the contracting parties happens to be the State. It has been observed in Para 26 as under:-

"26. A conspectus of the pronouncements of this court and the development of law over the past few decades thus show that there has been a notable shift from the stated legal position settled in earlier decisions, that termination of a contractual employment in accordance with the terms of the contract was permissible and the employee could claim no protection against such termination even when one of the contracting parties happened to be the State. Remedy for a breach of a contractual condition was also by way of civil action for damages/compensation. With the development of law relating to judicial review of administrative actions, a writ Court can now examine the validity of a termination order passed by public authority. It is no longer open to the authority passing the order to argue that its action (Downloaded on 25/11/2021 at 09:31:32 PM) (77 of 96) [CW-3540/2020] being in the realm of contract is not open to judicial review. A writ Court is entitled to judicially review the action and determine whether there was any illegality, perversity, unreasonableness, unfairness or irrationality that would vitiate the action, no matter the action is in the realm of contract. Having said that we must add that judicial review cannot extend to the Court acting as an appellate authority sitting in judgment over the decision. The Court cannot sit in the arm chair of the Administrator to decide whether a more reasonable decision or course of action could have been taken in the circumstances. So long as the action taken by the authority is not shown to be vitiated by the infirmities referred to above and so long as the action is not demonstrably in outrageous defiance of logic, the writ Court would do well to respect the decision under challenge."

15. In view of the above stated factual and legal position, the court does not find any merits in any of the writ petitions, and rather finds that the petitioners had misused the process of law by filing the petitions one after the other suppressing material facts, and therefore the petitions deserve to be dismissed with cost, which is quantified at Rs. 5,000/- per petition. All the writ petition stand dismissed with costs accordingly. The costs shall be paid to the respondent No. 3- college Dharmendra Singh & Others vs. State of Raj. and others."

The special appeal preferred against the judgement in the case of Dharmendra Singh and Ors., bearing no. D.B. SAW No.97/2015 and other connected matters, came to be dismissed by a Division Bench of this Court vide its judgement dated 5.2.2016.

A panoramic view of the aforesaid judgements of the Hon'ble Supreme Court as also of this Court makes the position clear that a (Downloaded on 25/11/2021 at 09:31:32 PM) (78 of 96) [CW-3540/2020] contractual employee appointed without facing a fair/transparent mode of selection, has no right to continue and the principle that no contractual employee can be replaced by another contractual employee, does not come to his rescue. Indisputably, in the case in hand, the petitioners were hired by the placement agency without following any such fair/transparent procedure of selection and hence, they have no right to continue in service.

Reliance placed by the petitioners on the judgement in the case of Mohd. Abdul Kadir & Anr. (supra) does not help them inasmuch as therein the scheme under which the appellants were employed, not through a placement agency, was in force for five decades and they were working on adhoc or temporary basis for decades.

Similarly, in the case of Jagdish Prasad Yadav & Ors. (supra), a coordinate bench of this Court has reiterated the general/broad principle that one set of contractual employees cannot be replaced by another set of contractual employees. The facts do not reveal as to whether the petitioners therein were engaged after following the transparent process of selection or not.

The judgement of this Court in the case of Shiv Charan Meena (supra) does not help the petitioners having been rendered in the different facts and circumstances. Therein, the services of the petitioner, who was working as contractual employees for last about six years, were replaced by another contractual employee. Therefore, on the general legal principle that one contractual employee cannot be replaced by another contractual employee, the writ petition was allowed.

(79 of 96) [CW-3540/2020] In the case of Pankaj Kumar Upadhaya & Ors. vs. State of Raj. & Ors., S.B. Civil Writ Petition No.953/2017 vide judgement dated 20.03.2017, a coordinate bench of this Court directed the respondents therein not to replace the petitioners engaged by the State officials on contract basis by another set of contractual employees either through direct recruitment or through placement agency. In that case also, the question as to whether the engagement of the petitioners was after following the fair recruitment process or not, was not considered.

In case of Mooli Devi Choudhary & Ors. vs. State of Raj. & Ors., 2010 (4) WLC (Raj.) 334, a coordinate bench of this Court held the engagement of petitioners-teachers under Sarva Shiksha Abhiyan, a project launched by the Government of India for achievement of Universalization of Elementary Education within the time frame as mandated by the 86th Amendment to the Constitution and/or Kasturba Gandhi Balika Vidhyalaya, the scheme for setting up residential school at Upper Primary School for girls belonging predominantly to the Scheduled Caste / Scheduled Tribes/ OBC and minority communities respectively, through placement agency to be unconstitutional and refused to acknowledge such teachers as the employees of the private placement agencies in absence of any enactment by the State Government to engage such employees through private placement agency. However, in the present case, as already held, the petitioners were engaged by the official respondents through placement agency under the provisions of the RTPP Act and hence, the petitioners cannot be extended benefit of the judgement in case of Mooli Devi Choudhary & Ors. (supra). (Downloaded on 25/11/2021 at 09:31:32 PM)

(80 of 96) [CW-3540/2020] There is another important aspect of the matter. In the backdrop of Circular dated 11.7.2018 issued by the State Government through Finance Department, the procurement agency, i.e., the respondents issued NIT culminating into an agreement dated 28.8.2018 entered into in between the procurement agency and the respondent no.4, the lowest bidder.

Certain terms of the agreement which are important for decision of the controversy in hand, are being quoted hereunder:

"8. The functional control over the deliverables provided by the second party will rest with ICDS and the disciplinary/administrative/Technical control will be with the second party.
19. The second party has to ensure that the deliverables/personnel hired for service points shall not claim any benefit/compensation/absorption/regularization of services from/in this office under the provision of Industrial Disputes Act, 1947 or Contract Labour (Regulation & Abolition) Act, 1970.
21. If the First party finds that any of the deliverables has committed serious misconduct or has been charged with having committed a criminal action, or shall the first party determine the second party deliverable have engaged in corrupt, fraudulent, collusive, coercive or obstructive practice while performing the Services, the second party shall, at the procurers written request, provide a replacement.
23. The first party may require the second party to dismiss or remove from the work place, any deliverables, provided by the second party, who may be incompetent or for his/her/their misconduct and the second party shall forthwith comply with such requirements. The second party shall replace immediately any of its deliverable, if they are unaccepted to this office because of security risk, incompetence, conflict of interest and breach of (Downloaded on 25/11/2021 at 09:31:32 PM) (81 of 96) [CW-3540/2020] confidentiality or improper conduct upon receiving written notice from office.
III GENERAL:
1. The duration of the assignment would be till 29 th August, 2019. Further, this contract shall automatically come to end unless it is renewed in writing. The ICDS Directorate reserves the rights to increase the contract period as per the RTPP Act & Rules on same terms and conditions, which not more than three months as per RTPP Act and Rule on same remuneration and fee charges.
13. That on the expiry of the agreement, the second party will withdraw all its personnel and clear their accounts by paying them all their legal dues. In case of any dispute on account of the termination of employment or non-

employment by the personnel of the second party, it shall be the entire responsibility of the second party to pay and settle the same."

A holistic view of the agreement, especially the aforesaid terms and conditions, leaves no room for doubt that the entire administrative and disciplinary control over the manpower provided by the service provider rests with it only and not with the official respondents and on expiry of the agreement, the personnel engaged by service provider will have no right to continue in the services irrespective of life of the scheme.

Petitioners were issued appointment orders by the service provider in the months of September/October, 2018. Some of the relevant conditions in the appointment letter dated 4.10.2018 of the petitioner Rohitash Verma, which are common in all the appointment orders, are as under:

"1. As the project work awarded to us by our clients is only for a certain period, your assignment with us initially (Downloaded on 25/11/2021 at 09:31:32 PM) (82 of 96) [CW-3540/2020] will be from- Oct 2018 to 29 th August 2019. If however, the project work is extended, your association with us may be extended for such further period as may be decided by us, hence this contract of employment by no means be treated or construed to be of permanent in nature granting thereby to you a status of permanent employee of the company.
3. Your job is subject to selection & transfer thereby to other establishments (place of work) as a part of rotation of duties or for administrative or other reasons. Any refusal to accept such transfer and report to the new place of duty shall be considered as gross misconduct and dealt with accordingly including termination of service.
4. You should give advance notice of at least one month before leaving the job, however rights of company are reserved to terminate your service with immediate effect without notice in the event of any complaint from the department about your non-acceptable performance/misconduct or lapses on duty or any indiscipline, dishonest activity by you."

Thus, it is apparent that services of the petitioners were hired by the service provider on contract basis and its life was commensurate with the life of the agreement, of course, subject to satisfactory performance. The petitioners have accepted the terms of the appointment order fully conscious of the same with open eyes and hence, doctrine of election estops them from claiming exemption after availing benefit under it. The Hon'ble Apex Court has, in case of Dhanjit Singh Sandhu (supra), held as under:

"22. The doctrine of "approbate and reprobate" is only a species of estoppel, it implies only to the conduct of parties. As in the case of estoppel it cannot operate against the provisions of a statute. (vide C.I.T. vs. Mr. P. Firm Muar, AIR 1965 SC 1216).

23. It is settled proposition of law that once an order has been passed, it is complied with, accepted by the other party and derived the benefit out of it, he cannot challenge it on any ground. (Vide Maharashtra State Road Transport Corporation vs. Balwant Regular Motor Service, Amravati & Ors., AIR 1969 SC 329). In R.N. Gosain vs. Yashpal Dhir, (1992) 4 SCC 683, this Court has observed as under:-
"10.Law does not permit a person to both approbate and reprobate. This principle is based on the doctrine of election which postulates that no party can accept and reject the same instrument and that "a person cannot say at one time that a transaction is valid and thereby obtain some advantage, to which he could only be entitled on the footing that it is valid, and then turn round and say it is void for the purpose of securing some other advantage."

24. This Court in Sri Babu Ram vs. Sri Indra Pal Singh (Dead) by LRs., (1998) 6 SCC 358, and P.R. Deshpande vs. Maruti Balram Haibatti, (1998) 6 SCC 507, Court has observed that:

"8. The doctrine of election is based on the rule of estoppel- the principle that one cannot approbate and reprobate inheres in it. The doctrine of estoppel by election is one of the species of estoppel in pais (or equitable estoppel) which is a rule in equity. By that law, a person may be precluded by his actions or conduct or silence when it is his duty to speak, from asserting a right which he otherwise would have had."

25. The Supreme Court in Rajasthan State Industrial Development and Investment Corporation and Anr. vs. Diamond and Gem Development Corporation Ltd. and Anr., (2013) 5 SCC 470, made an observation that a party cannot be permitted to "blow hot and cold", "fast and (Downloaded on 25/11/2021 at 09:31:32 PM) (84 of 96) [CW-3540/2020] loose" or "approbate and reprobate". Where one knowingly accepts the benefits of a contract or conveyance or an order, is estopped to deny the validity or binding effect on him of such contract or conveyance or order. This rule is applied to do equity, however, it must not be applied in a manner as to violate the principles of right and good conscience.

26. It is evident that the doctrine of election is based on the rule of estoppel, the principle that one cannot approbate and reprobate is inherent in it. The doctrine of estoppel by election is one among the species of estoppel in pais (or equitable estoppel), which is a rule of equity. By this law, a person may be precluded, by way of his actions, or conduct, or silence when it is his duty to speak, from asserting a right which he would have otherwise had." Further, the petitioners have not assailed the validity or legality of either the agreement dated 28.8.2018/24.7.2020 or the appointment letters issued by the placement agency in their favour in absence whereof, even otherwise also, they cannot be held entitled for the relief claimed.

The petitioners' services have been hired for implementation of NNM floated by the Government of India with a salutary object to achieve improvement in nutritional status of children from 0-6 years, pregnant women, and lactating mothers in a time bound manner. As is revealed from the letter of the Government of India dated 18.12.2017 (Annexure-1), it is an externally aided project and is funded by government budgetary support (50%) with its further bifurcation in the ratio of 60:40 in between the Centre and the State and rest 50% by IDRD and other MDB. The State Government is the implementing agency. In view of the limited (Downloaded on 25/11/2021 at 09:31:32 PM) (85 of 96) [CW-3540/2020] budgetary provision and the laud object behind the scheme, this Court finds substance in the submission of the learned Advocate General that the State Government took a conscious policy decision to have manpower through placement agency as it could not afford to have major portion of the budget consumed towards salary component. Further, under the provisions of the RTPP Act, 2012, the State Government is empowered to hire the manpower service through a placement agency. It is well settled legal position that an employer has exclusive domain in the matters relating to inter alia prescribing the source/mode of recruitment and unless it is tainted with malafide or is arbitrary per se, the scope of judicial interference is very limited. Their Lordships of the Hon'ble Apex Court in Union of India & Ors. vs. Pushpa Rani & Ors.-(2008) 9 SCC 242, held as under:

"37. Before parting with this aspect of the case, we consider it necessary to reiterate the settled legal position that matters relating to creation and abolition of posts, formation and structuring/restructuring of cadres, prescribing the source/mode of recruitment and qualifications, criteria of selection, evaluation of service records of the employees fall within the exclusive domain of the employer. What steps should be taken for improving efficiency of the administration is also the preserve of the employer. The power of judicial review can be exercised in such matters only if it is shown that the action of the employer is contrary to any constitutional or statutory provision or is patently arbitrary or is vitiated due to mala fides. The Court cannot sit in appeal over the judgment of the employer and ordain that a particular post be filled by direct recruitment or promotion or by transfer. The Court has no role in determining the methodology of recruitment or laying down the criteria of selection. It is also not open the Court to make comparative (Downloaded on 25/11/2021 at 09:31:32 PM) (86 of 96) [CW-3540/2020] evaluation of the merit of the candidates. The Court cannot suggest the manner in which the employer should structure or restructure the cadres for the purpose of improving efficiency of administration."

Allegation of mala fide in engaging petitioners through a placement agency is completely missing herein and as already observed, such mechanism is permissible under the RTPP Act. So, this Court finds no illegality in engaging services of the petitioners through placement agency. A coordinate bench of this Court has, in the case of, Bhuvnesh Gautam (supra), while dealing with an identical situation wherein the petitioners were engaged by the official respondents through placement agency on contract basis, held as under:

"21. While such a principle has been laid down to be correct, still the question arises whether original employment on contract has been given in accordance with law or not i.e. whether the selection process was adopted in consonance with transparency and fair play before making appointments on contract basis. The appointments made through placement agency resulted in candidates having been appointed by back door method who have been appointed without undergoing any selection. The administration and functioning of any State entity, if allowed to be handed by such employees, would result in causing administrative chaos and non-governance as they have no accountability. Sooner, or later we may end up every appointment being made on contract basis and encourage situation where the people may start bidding for the posts in the State Government or its instrumentalities which would result in nothing but encouragement of corruption. Such concept would demolish the very basis of our Indian Constitution system.

23. At the same time, in view of what has been stated hereinabove, the RSLDC is restrained from engaging the persons for its various projects, through placement agency or service providers or any other nomenclature which it may so assign."

However, a Division Bench of this Court has, in D.B. Special Appeal (Writ) No.822/2019 and other connected matters preferred by the State Government, stayed the judgement dated 28.2.2019 to the extent it restrains the State Government from engaging the manpower through placement agency. In view of the matter being subjudice before a division bench of this Court, this Court would not like to dwell deeper into the issue. However, as already observed, this Court finds no illegality in the mechanism adopted by the official respondents for hiring manpower for implementing NNM through a placement agency which is, otherwise also permissible under the RTPP Act.

Their Lordships of the Hon'ble Supreme Court, in the case of K.K. Suresh & Anr. vs. Food Corporation of India & Ors.-(2018) 17 SCC 641, held as under:

"3. The appellants claiming to be working as clerical staff filed writ petitions against Food Corporation of India-FCI (Respondent 1 herein) in the Kerala High Court and prayed therein that their services be regularized on their respective posts on which they were working since 1997 in the set-up of FCI. In other words, the appellants (petitioners therein) claimed a relief of regularization of their services in the set-up of FCI as regular employees of the FCI.
4. Respondent 1 (FCI) contested the writ petitions inter alia on the ground that the appellants are not the employees of FCI and nor were they ever appointed by the FCI in their set up but they (appellants) were appointed as clerical staff by (Downloaded on 25/11/2021 at 09:31:32 PM) (88 of 96) [CW-3540/2020] one Co-Operative Society called "FCI Head Load Workers Co- Operative Society". It was, therefore, contended that in the absence of any kind of relationship of the employer and the employee between the appellants and FCI, a relief of either absorption or regularization in the services of FCI does not arise and nor any relief of this nature can be granted to the appellants against FCI.
5. The Single Judge of the High Court, by order dated 16.01.2002, dismissed the appellants' writ petitions. The appellants felt aggrieved and filed intra-court appeals before the Division Bench. By impugned order, the Division Bench dismissed the appeals and affirmed the order of the Single Judge, which has given rise to filing of these appeals by special leave by the unsuccessful writ petitioners.
6. Having heard the learned counsel for the parties and on perusal of the record of the case, we find no merit in these appeals. In our considered opinion, the writ Court and the Division Bench were right in dismissing the appellants' writ petitions and we do not find any reason to differ with the view taken by the two Courts below.
7. In the first place, the appellants failed to adduce any evidence to prove existence of any relationship between them and FCI; second, when the documents on record showed that the appellants were appointed by FCI Head Load Workers Co- Operative Society but not by FCI then obviously the remedy of the appellants, if at all, in relation to their any service dispute was against the said Society being their employer but not against FCI; third, FCI was able to prove with the aid of evidence that the appellants were in the employment of the said Society whereas the appellants were not able to prove with the aid of any documents that they were appointed by FCI and how and on what basis they claimed to be in the employment of FCI except to make an averment in the writ petitions in that behalf. It was, in our opinion, not sufficient to grant any relief to the appellants."

(89 of 96) [CW-3540/2020] In view thereof, this Court is not persuaded to accept the contention of the learned counsel for the petitioners that they be treated as employees of the State Government.
Contention of the learned counsel for petitioners that since they are essential component in implementation of the NNM by the State Government, the placement agency has been hired only to create an artificial barrier in between them and the principal employer, deserves to be rejected. It is nobody's case that the NNM is perennial in nature. As already observed, the scheme has limited budget, 50% of which is to be funded by the non-government agencies. In the backdrop of the RTPP Act and circular dated 11.7.2018 issued by the Finance Department, the Government of Rajasthan, the official respondents took a policy decision to hire manpower through placement agency. The petitioners have nowhere challenged the competence of the State Government in hiring the manpower through placement agency. This Court does not find from the material on record the policy decision of the State Government to be suffering from the vice of arbitrariness/illegality warranting interference under its writ jurisdiction. Even otherwise also, it is settled proposition of law that the question as to whether manpower is hired through a contractor as a camouflage or whether the State Government happens to be principal employer, cannot be entertained by this Court in writ jurisdiction and it has to be established before an industrial adjudicator.
A Constitution Bench of the Hon'ble Apex Court in the case of Steel Authority of India & Ors. vs. National Union Waterfront Workers & Ors.-(2001) 7 SCC 1 held as under:

(90 of 96) [CW-3540/2020] "125.xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx the industrial adjudicator will have to consider the question whether the contractor has been interposed either on the ground of having undertaken to produce any given result for the establishment or for supply of contract labour for work of the establishment under a genuine contract or is a mere ruse/camouflage to evade compliance of various beneficial legislations so as to deprive the workers of the benefit thereunder. If the contract is found to be not genuine but a mere camouflage, the so-called contract labour will have to be treated as employees of the principal employer who shall be directed to regularise the services of the contract labour in the concerned establishment subject to the conditions as may be specified by it for that purpose in the light of para 6 hereunder."
"126. We have used the expression industrial adjudicator by design as determination of the questions afore-mentioned requires inquiry into disputed questions of facts which cannot conveniently be made by High Courts in exercise of jurisdiction under Article 226 of the Constitution. Therefore, in such cases the appropriate authority to go into those issues will be industrial tribunal/court whose determination will be amenable to judicial review."

Relying on the aforesaid judgement, in the case of A.P. SRTC & Ors. (supra), their Lordships held as under:

"11. xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx In view of the principles laid down in Steel Authority, the High Court could not have directed absorption of respondents who were held to be contract labour, by assuming that the contract labour system was only a camouflage and that there was a direct relationship of employer and employee between the corporation and the respondents xxxxxxxxxxxxxxxxxxxxxxxxxxxxxx."

12. xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx The only remedy of respondents, as noticed above, is to approach the Industrial Tribunal for declaring that the contract labour system under which they were employed was a camouflage and therefore, they were, in fact, direct employees of the Corporation and for consequential relief xxxxxxxxxxxxxxxxxxxxxxxxxxxxx."

Submission of the learned counsel for the petitioners that since their appointment orders were subject to confirmation by the official respondents, they should be treated as government employees, does not merit acceptance. The contention is based on the letter dated 5.10.2018 issued by the respondent no.2 whereby the respondent no.5, the Deputy Directors, Women and Child Development Department have been directed to verify Bio Data of the manpower in the light of their educational qualification.

The NIT issued by the official respondent no.2 for procurement of manpower services contains essential qualifications for various posts. The agreement requires the service provider to hire services of qualified personnel only. Though, the appointment of the petitioners by the service provider was not subject to confirmation by the official respondents, but, it does not denude them from ascertaining that the manpower so provided by the placement agency possesses the minimum eligibility laid down under the NIT rather, it was their obligation and such verification, by no stretch of imagination, can be reckoned as appointment subject to confirmation by the official respondents.

The judgement in the case of Dr. Janet Jeyapaul (supra), is of no help to the petitioner in the facts and circumstances of this (Downloaded on 25/11/2021 at 09:31:32 PM) (92 of 96) [CW-3540/2020] case. Their Lordships, in that case laid down twin test to cover an authority under Article 12, i.e., whether it is discharging any public function or public duty and if so, whether it is actually engaged in any public function or/and performing any such duty. The emphasis is always on activity undertaken and the nature of the duty imposed on such authority. Therein, the university was deemed to be subject to writ jurisdiction because it was performing function of imparting education to the children which is mostly been treated as public function or the duty and secondly, it was a deemed university under Section 3 of the University Grants Commission Act, 1956 and was bound by the provisions contained therein. Herein, the placement agency has supplied the manpower in terms of the agreement executed in between it and the official respondents. Undeniably, the placement agency can also supply manpower to private sector also. The petitioners have failed to lay down any factual foundation to show that the private respondent is discharging any public function or public duty. Mere facilitation of the manpower to the State, cannot be reckoned as discharging any public function/duty so as to cover it under 'other authority' within Article 12.

In the conspectus of the aforesaid discussion, this Court is of the view that the petitioners have failed to establish any legal right to continue in service irrespective of change of placement agency or to claim their status as government employee or to claim the salary directly from the Government as also any corresponding legal obligation of the official respondents to continue them as their employees irrespective of change of placement agency. It is trite law that in absence of establishment of the legal right in favour of (Downloaded on 25/11/2021 at 09:31:32 PM) (93 of 96) [CW-3540/2020] the petitioners and corresponding legal obligation of the State, no mandamus can be issued. A three-Judges Bench has, in the case of the Bihar Eastern Gangetic Fishermen Cooperative Society Ltd. vs. Sipahi Singh & Ors.-(1977) 4 SCC 145, held as under:

"Re : Contention No. 3 :-This contention is also well founded and must prevail. There, is abundant authority in favour of the proposition that a writ of mandamus can be granted only in a case where there is a statutory duty imposed upon the officer concerned and there is a failure on the part of that officer to discharge the statutory obligation. The chief function of a writ is to compel performance of public duties prescribed by statute and to keep subordinate tribunals and officers exercising public functions within the limit of their jurisdiction. It follows, therefore, that in order that mandamus may issue to compel the authorities to do something, it must be shown that there is a statute which imposes a legal duty and the aggrieved party has a legal right under the statute to enforce its performance. (See Lekhraj Satramdas, Lalvani v. Deputy Custodian-cum-Managing Officer & Ors.-AIR 1966 SC 334, Dr. Rai Shivendra Bahadur v. The Governing Body of the Nalanda College-AIR 1962 SC 1210 and Dr. Umakant Saran v. State of Bihar & Ors.-AIR 1973 SC 964. In the instant case, it has not been shown by respondent No. 1 that there is any statute or rule having the force of law which casts a duty on respondents 2 to 4 which they failed to perform. All that is sought to be enforced is an obligation flowing from a contract which, as already indicated, is also, not binding and enforceable, Accordingly, we are clearly of the opinion that respondent No. 1 was not entitled to apply for grant of a writ of mandamus under Article 226 of the Constitution and the High Court was not competent to issue the same."

(94 of 96) [CW-3540/2020] Similarly, another three-Judges Bench, in the case of Director of Settlements, A.P. & Ors. vs. M.R. Apparao & Anr.-(2002) 4 SCC 638, proceeded to held as under:
"17.Coming to the third question, which is more important from the point of consideration of High Court's power for issuance of mandamus, it appears that the constitution empowers the High Court to issue writs, directions or orders in the nature of habeas corpus, mandamus, prohibition, quo warranto and certiorari for the enforcement of any of the rights conferred by Part III and for any other purpose under Article 226 of the Constitution of India. It is, therefore essentially, a power upon the High Court for issuance of high prerogative writs for enforcement of fundamental rights as well as non-fundamental or ordinary legal rights, which may come within the expression 'for any other purpose'. The powers of the High Courts under Article 226 though are discretionary and no limits can be placed upon their discretion, it must be exercised along recognised lines and subject to certain self-imposed limitations. The expression 'for any other purpose' in Article 226, makes the jurisdiction of the High Courts more extensive but yet the Court must exercise the same with certain restraints and within some parameters. One of the conditions for exercising power under Article 226 for issuance of a mandamus is that the Court must come to the conclusion that the aggrieved person has a legal right, which entitles him to any of the rights and that such right has been infringed. In other words, existence of a legal right of a citizen and performance of any corresponding legal duty by the State or any public authority, could be enforced by issuance of a writ of mandamus. "Mandamus"

means a command. It differs from the writs of prohibition or certiorari in its demand for some activity on the part of the body or person to whom it is addressed. Mandamus is a command issued to direct any person, corporation, inferior Courts or Government, requiring him or them to do some particular thing therein specified which appertains to his or (Downloaded on 25/11/2021 at 09:31:32 PM) (95 of 96) [CW-3540/2020] their office and is in the nature of a public duty. A mandamus is available against any public authority including administrative and local bodies, and it would lie to any person who is under a duty imposed by statute or by the common law to do a particular act. In order to obtain a writ or order in the nature of mandamus, the applicant has to satisfy that he has a legal right to the performance of a legal duty by the party against whom the mandamus is sought and such right must be subsisting on the date of the petition.{Kalyan Singh vs. State of U.P., AIR 1962 SC 1183}. The duty that may be enjoined by mandamus may be one imposed by the Constitution, a statute, common law or by rules or orders having the force of law. When the aforesaid principle are applied to the case in hand, the so-called right of the respondents, depending upon the conclusion that the amendment Act is constitutionally invalid and, therefore, the right to get interim payment will continue till the final decision of the Board of Revenue cannot be sustained when the Supreme Court itself has upheld the constitutional validity of the amendment Act in Venkatagiri's case on 4th of February, 1986 in Civil Appeal No. 398 & 1385 of 1972 and further declared in the said appeal that interim payments are payable till determination is made by the Director under Section 39(1). The High Court in exercise of power of issuance of mandamus could not have said anything contrary to that on the ground that the earlier judgment in favour of the respondents became final, not being challenged. The impugned mandamus issued by the Division Bench of the Andhra Pradesh High Court in the teeth of the declaration made by the Supreme Court as to the constitutionality of the amendment Act would be an exercise of power and jurisdiction when the respondents did not have the subsisting legally enforceable right under the very Act itself. In the aforesaid circumstances, we have no hesitation to come to the conclusion that the High Court committed serious error in issuing the mandamus in question for enforcement of the so- called right which never subsisted on the date, the Court (Downloaded on 25/11/2021 at 09:31:32 PM) (96 of 96) [CW-3540/2020] issued the mandamus in view of the decision of this Court in Venkatagiri's case. In our view, therefore, the said conclusion of the High Court must be held to be erroneous." The upshot of the aforesaid discussion is that the petitions are devoid of merit and deserve to be dismissed.

The petitions are dismissed accordingly.
