Order No.10               In this matter we have heard the Learned Counsel for the parties

6th March, and perused the record filed by the Respondent No. 1. It is borne out of 2017 the matter pertaining to compliance by the LOI for the purpose of excavation / mining in the disputed site. After the matter was heard by the Hon'ble High Court of Rajasthan the matter is now pending before the Hon'ble Supreme Court.

In view of the above, we are of the view that till the matter is finally decided by the Hon'ble Supreme Court this Tribunal cannot proceed in the matter and issues that have been raised before us. We, therefore, direct that this matter be consigned to record with liberty to the parties (Applicant) to approach the Hon'ble Supreme Court in the matter if so advised. In the alternate it would be open for the any of the party to bring to the notice of this Tribunal for reopening the matter after the decision is given by the Hon'ble Supreme Court.

With the aforesaid directions, this matter stands disposed of and consigned to record with liberty as aforesaid.
