1. The instant Transfer Petition has been filed by the petitioner-wife under Section 25 of the Code of Civil Procedure, 1908 for transfer of divorce case viz., F.C.O.P. No.136 of 2022, titled “Chimakurthi Srinivas v. Chimakurthi K. Sailaja” pending before Family Court, Ongole, Andhra Pradesh to Sub Court, Alandur, Chennai in Tamil Nadu.
2. Heard learned counsel for the petitioner. Despite being served the respondent-husband has not chosen to enter appearance and contest the matter.
3. Having perused the petition papers and materials available on- record, we are of the view that this Transfer Petition deserves to be allowed. In that view of the matter the Family Court, Ongole, Andhra Pradesh, where divorce case in F.C.O.P. No.136 of 2022 is pending is directed to transmit the entire records of the said case to the transferee court, expeditiously. Upon such transfer it will be open to the respondent-husband to seek permission of the transferee Court to attend the proceedings virtually, except on Signature Not Verified Digitally signed by Vijay Kumar Date: 2023.08.12 occasions where his physical presence is inevitable. 12:27:24 IST Reason:
