Section 48 in Adoption Regulations, 2017

48. Adoption of children with special needs.

(1)The adoption process for children with special needs shall be completed as expeditiously as possible by the agencies or authorities concerned, who shall be available for adoption by resident Indians and Non-Resident Indians from the date they are declared legally free for adoption by the Child Welfare Committee:Provided that such children with special need shall be available for adoption by Overseas Citizen of India or foreign adoptive parents, after fifteen days from the date they are declared legally free for adoption.
(2)Special care shall be taken while processing the cases for adoption of children with special needs, so that the prospective adoptive parents are aware of exact medical condition of the child and are ready to provide extra care and attention that the child needs.
(3)The types of children with special needs are available in Schedule XVIII, which is illustrative and not exhaustive; the same may also be accessed from www.cara.nic.in, and the decision of the Authority shall be final in this regard.
(4)The children with special needs who were not adopted shall be provided due care and protection by the Specialized Adoption Agency and if they do not have necessary facilities and the means for their long term care, such children shall be shifted to any other specialized institutions run by any Government or non-Government organization.
