   FACTS

Heard today dated 1.3.2013. Appellant not present but is represented by his father Shri Vikram Singh. The Department is represented by Shri R. K. Ahluwalia, Under Secretary.

2. In the RTI application dated 22.10.2012, the appellant had essentially sought to know whether the diploma holders of the Naturo Electro Homeopathy of India could practice in the country. The CPIO, vide letter dated 22.11.2011, had informed the appellant that the contents of the letters dated 25.11.2003 , 5.5.2010 and 21.1.2011 of the Department were self speaking and needed no clarification. In other words, the CPIO did not respond to the query in a clear and categorical manner.

3. During the hearing, R. K. Ahluwalia produces a copy of the order dated 25.11.2003 issued by Jt. Secretary of the Ministry which refers to the acceptance of the recommendation of the Expert Committee by the Ministry for permitting certain practices such as acupuncture and hypnotherapy which qualify as modes of therapy. Suffice to say that even this order does not answer the appellant's query in a clear and categorical manner.

4. In view of the above, the Department of Health Research is hereby directed to examine the matter in depth and provide a categorical response to the appellant in 06 weeks.
