Sanjay Kumar Singh, applicant herein, has filed this Original Application under Section 19 of the Administrative Tribunals Act, 1985 seeking direction to be issued to the respondents not to consider any other category of teachers for promotion to the post of PGT (English), who do not have requisite qualification and experience as TGT (English). Even though the relief asked for is not happily worded, but in fact what the applicant is asking for is to promote him to the post of TGT (English).
2. During the course of the arguments, it could not be disputed that the post of TGT (English) is covered under the rules and, therefore, the applicant is entitled to be considered for promotion on the said post. That being so, we dispose of this Original Application directing the respondents to treat this OA as representation of the applicant and appropriate orders thereon shall be passed as expeditiously as possible and preferably within a period of six weeks from today. In considering the case of the applicant, the respondents would also look into plea raised by him that persons junior to him have already been promoted to the post of TGT (English). In case if the plea of the applicant is found to be correct, he would be promoted from a date if found fit when the person immediately junior to him may have been promoted.
3. This Original Application is disposed of with directions as above. No costs.
