73. Death of Judgement-debtor-Execution against legal representative.
(1)Where a Judgement-debtor dies before the decree has been fully satisfied, an application under sub-rule (1) of Rule 62 may be made or continued against the legal representative of the deceased and thereupon all the provisions of this chapter shall, save as otherwise provided in this rule, apply as if such legal representative were the Judgement-debtor :Provided that a show cause notice shall be issued to such legal representative and his objections heard, before execution is against him.(2)Where the decree is executed against such legal representative, he shall be liable only to the extent of the property of the deceased which has come to his hands, the Recovery Officer executing the decree may, of his own motion or on the application of the decree-holder, compel such legal representative to produce such accounts as he thinks fit.
