Section 12B in The Aircraft Act, 1934

12B. Cognizance of offences.-

(1)No court shall take cognizance of any offence punishable under this Act, save on a complaint made by or with the previous sanction in writing by theDirector General of Civil Aviation or Director General of Bureau of Civil Aviation Security or Director General ofAircraft Accidents Investigation Bureau, as the case may be.
(2)The complaint referred to in sub-section (1) shall be made within a period of one year from the date on which the offence came to the knowledge of the Director General of CivilAviation or Director General of Bureau of CivilAviation Security or Director General ofAircraft Accidents Investigation Bureau, as the case may be.
(3)Notwithstanding anything contained in the Code of Criminal Procedure, 1973, no court inferior to that of a Metropolitan Magistrate or a Magistrate of the first class shall try the offences under this Act.".
