This matter is taken up for hearing under the caption “For Being
Mentioned” today at the instance of the learned counsel for appellant.
2. The learned counsel for appellant submitted that earlier, this Court,
by an order dated 25.02.2026 admitted the Second Appeal. However, he
would submit that in the said order, though the stay order passed by this
court, it was not reflected in the order. Hence, he prayed to mention the same
in the order and issue fresh order copy.
3. Considering his submissions, at the end of para 5, the words viz.,
“Until then, all further proceedings in the Judgment and Decree passed
in A.S.No. 55 of 2018 on the file of Subordinate Court, Paramathi is
ordered to be stayed” shall be added.
4. Registry is directed to incorporate above correction in the judgment
of this Court in S.A.No. 173 of 2026 dated 25.02.2026 and issue fresh order
copy to the appellant.

Challenging the reversal findings of the Courts below, the appellants have preferred this appeal.
2.Heard the learned counsel for the appellants and perused the material available on records.

“1. Is that the Lower Appellate Court right in reversing the Judgment of the Trial Court without considering the alternate pathway admitted by the evidence of the plaintiff?
2. Is that the Lower Appellate Court right in allowing the appeal without proper reason rendered for reversing the Judgment of Trial Court in absence of evidence for the plaintiffs used the subject matter pathway?
