Notice is made returnable on 06.05.2019. Since Mr. R Saha, learned counsel appears and waives notice for the respondents, no formal notice is called for.
At the outset, Ms. Chisim, learned counsel has pointed out that the dispute raised in this petition is squarely covered by a previous decision of this court in Monoranjan Naha vs. State of Tripura & Anr., (the judgment and order dated 26.04.2017 delivered in WP(C) No. 255/2014).
While filing the reply the respondents should take care of the said decision and make their averments categorical whether the previous decision encompasses the controversy or not.
