1. Mr. Sanjay Bansal, learned counsel for the petitioners, states that the petitioners in all five petitions are Non-Resident Indians. As such the proposed arbitrations would be "International Commercial Arbitration"
within the meaning of Section 2(1)(f) of the Arbitration and Conciliation Act, 1996 ["the Act"] and the jurisdiction to appoint arbitrators under Section 11 of the Act lies with the Supreme Court of India.
2. In these circumstances, Mr. Bansal seeks permission to withdraw these petitions with liberty to approach the appropriate Court on the same cause of action.
3. The petitions, alongwith all the pending applications, stand dismissed as withdrawn with liberty as aforesaid.
