Respondent has refused service. Therefore, he is proceeded against ex-parte.

Petitioner seeks transfer of petition bearing no.DMC No.2/2018 filed under Section 13 of Hindu Marriage Act, 1955 by the respondent titled as Avtar Singh vs. Nasib Kaur pending before the Court of learned Additional District Judge, Ferozepur to a Court of competent jurisdiction at District Tarn Taran.

It is stated that two cases between the parties are pending. One is under Section 125 Cr.P.C. and other is criminal complaint under Sections 406, 498-A IPC at Patti Courts, District Tarn Taran. Petitioner being a lady cannot go from Patti to Ferozepur Courts, which is about 80 kms. from Tarn Taran. It is stated that petition has been filed just to harass the petitioner.

Considering the entirety of circumstances and also the fact that 1 of 2 ::: Downloaded on - 13-05-2018 12:42:29 ::: TA-187-2018 (O&M) 2 the respondent has refused the service, petition bearing no.DMC No.2/2018 filed under Section 13 of Hindu Marriage Act, 1955 by the respondent titled as Avtar Singh vs. Nasib Kaur pending in the Court of learned Additional District Judge, Ferozepur is withdrawn from the said Court and is transferred to learned District Judge, Tarn Taran, who may retain the same himself or entrust it to a Court of competent jurisdiction.

Present petition stands allowed accordingly.
