Bench: Abhinand Kumar Shavili
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI
WRIT PETITION No.21741 of 2021
ORDER:
This writ petition is being disposed of at the admission stage with the consent of both parties.
2. This writ petition is filed seeking the following relief:
"...to issue a Writ, Order or direction more in the nature of Mandamus declaring the action of the respondents in not implementing the new PRC issued by the Government vide G.O.Ms.No.51 Finance (HRM.IV) Department, dt. 11.6.2021 to the petitioners as illegal, arbitrary and in utter violation of Article 14, 16 and 21 of the Constitution of India and consequentially direct the respondents to forthwith implement new PRC to the petitioners in the interests of justice and to pass such other order or orders as this Hon'ble High Court may deem fit and proper in the circumstances of the case."
3. Heard Sri P.V. Ramana, learned counsel for the petitioners, and the learned Government Pleader appearing for the respondents.
4. It has been contended by the petitioners that they are recruited as Secondary Grade Teachers vide proceedings dated 21.07.2012 in pursuance of 2008 DSC Recruitment Notification and, since then, they have been discharging their duties to the best satisfaction of their superiors and everyone concerned. The grievance of the petitioners is that the State Government has come with Revised Pay Scales, 2020 and the same were issued vide G.O.Ms.No.51 dated 11.06.2021, but 2 AKS,J WP.No.21741 of 2021 the respondents are not extending the said Revised Pay Scales, 2020 to them.
5. Therefore, counsel for the petitioners contended that Revised Pay Scales, 2020 are issued vide G.O.Ms.No.51 dated 11.06.2021 and in the said G.O., it is made clear that the Revised Pay Scales would come into force from 01.07.2018. Admittedly, in the instant case, the petitioners were appointed on 21.07.2012, but the respondents are not extending the Revised Pay Scales, 2020 to the petitioners. Therefore, counsel for the petitioners further contended that appropriate orders be passed in this writ petition directing the respondents to extend the Revised Pay Scales, 2020 issued vide G.O.Ms.No.51 dated 11.06.2021 with all consequential benefits, to the petitioners.
6. Government Pleader appearing for the respondents had contended that let the petitioners submit a representation afresh to the respondents, then the respondents would consider the same and pass appropriate orders in accordance with law.
7. This Court, having considered the rival submissions made by learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing the petitioners to submit a representation afresh to the respondents within a period of two weeks from the date of receipt of a copy of this order, staking their claim for payment of Revised Pay Scales, 2020 issued vide G.O.Ms.No.51 dated 11.06.2021. Upon such a representation being 3 AKS,J WP.No.21741 of 2021 received, the respondents shall consider the same and pass appropriate orders, in accordance with law, in another eight weeks thereafter.
8. With the above directions, this writ petition is disposed of. No order as to costs.
Pending miscellaneous petitions, if any, shall stand closed.
