8 12-07-2011The judgment annexed as Annexure-8 to the counter affidavit in one of the cases is reported in 1995 (2) P.L.J.R. page 378 (Binod Kumar Singh Vs. State of Bihar).
Learned counsel for the State has produced before us copy of a order dated 28th January, 2003 whereby a Division Bench of this Court has dismissed the L.P.A. No. 703/1995 preferred by Binod Kumar Singh and others along with another L.P.A. and has confirmed the judgment of the learned Single Judge in the case of Binod Kumar Singh and others (supra). A submission was advanced on behalf of petitioners that an earlier judgment of a Single Judge in the case of Jagnandan Singh and others dated 18th January, 1995, though distinguished in the case of Binod Kumar Singh has been given effect to along with another judgment mentioned in paragraph 6 of that judgment and as a result, it has been asserted that in some districts of Bihar similarly situated Physical Trained Teachers are getting Matric Trained scale and this would lead to denial of equality amongst similar teachers.
Learned counsel appearing for the State of Bihar prays for some time to take instruction as to what was the final out come in relation to the judgment in the case of Jagnandan Singh and others (Annexure-4 to C.W.J.C. No. 6985 of 1997 and another judgment indicated in paragraph 6 thereof.
As prayed for on behalf of the State, Let this case be listed under the same heading on 1st August, 2011.
The case shall retain its position in the list.
