Learned counsel for the petitioners contends that for wholly unfounded reasons, the claim of the petitioner for training of Graduate Siksha Mitra under the Distant Education Scheme is not being considered.

Issue notice, returnable in three weeks.

A large number of cases are being received in this court with the plea that the persons serving as Siksha Mitra are not being considered for training, because they passed graduation after joining as Siksha Mitra. The issue appears to be covered by the decision rendered by this court in Writ Petition No.5084(SS) of 2011, Pratibha Dwivedi v. State of U.P. & ors., dated 16 August, 2011.

Respondent No.1 i.e. State of U.P. through Secretary, Basic Education, Government of U.P., is directed to take note of the above noted issue in context of the law as laid down by this court and apprise all the authorities at the District Level to follow the law, as laid down by this court, and not to reject the claims on whimsical grounds so as to avoid multiplicity of litigation.
