3. These are the petitions filed under Section 29A of the Arbitration and Conciliation Act, 1996 (for short, "the Act") whereby the petitioner has prayed for extension of time for a period of 9 months to complete the arbitral proceedings and publish an award. It is submitted that cross-examination of the respondent's witness is in progress. Already initial period of 12 months and the extended period of 6 months have lapsed as per Section 29A of the Act.
4. Having considered the averments as made in the petition, the mandate of the arbitral tribunal to conclude the arbitral proceedings and publish an award is required to be extended by a period of nine months. Accordingly, the petition is allowed in terms of prayer clause (a). The arbitral tribunal shall make an endeavour to conclude the arbitral proceedings and publish an award within the extended period so that there is no need to the parties to apply for a further extension. The parties shall co-operate in the early disposal of the arbitral proceedings.
5. Disposed of. No costs.
