Learned counsel for respondents No.1 and 2 submits that since during the pendency of the present revision petition, learned trial court, vide order dated 22.11.2016, has returned the plaint, invoking its powers under Order 7 Rule 10 CPC, with liberty to the plaintiff-petitioner to present the same before the learned court which is having the jurisdiction to adjudicate the suit, present revision petition would not survive and the same may be disposed of, as having been rendered infructuous.

Faced with the above, learned counsel for the petitioner also fairly states that since order dated 22.11.2016 is a judicial order, present revision petition has been rendered infructous and may be disposed of such.

In view of the above, present revision petition is disposed of, as having been rendered infructuous.
