COMMON ORDER SRI. AJITH KUMAR D. : JUDICIAL MEMBER Smt. Dhanya Mary Varghese, Director-sales, Samson & Sons Builders and Developers (P) Ltd. has filed seventeen review applications in 17 complaints disposed of by this Commission by resorting to Section 50 of the Consumer Protection Act 2019. The review sought for is on fixing joint liability upon the petitioner with other opposite parties.
2. Since the issue involved in all the petitions is one and the same and the petitions being stereotype with difference only in the number of the cases and the rank of the petitioner these petitions are disposed of vide this common order for the sake of convenience and to avoid wastage of time. The aforesaid cases were filed by different complainants alleging deficiency of service and unfair trade practice on the part of the opposite parties in collecting funds and not completing the construction of apartments/villas and failure in handing over the same as assured in the written agreements.
4. The first opposite party is a private limited Company and the remaining opposite parties are the Managing Director and Directors of the first opposite party. The petitioner would allege that she is not involved or connected with the day-to-day affairs of the company and nothing was brought before this Commission to prove her involvement in the transactions alleged in the cases. According to the petitioner this Commission has committed a mistake in fastening liability on her since she is not a person connected with the alleged transactions. Hence the petitioner would seek for reviewing the orders passed in 17 cases by exonerating her. According to the petitioner the order fixing liability on her in the absence of evidence about her involvement is an error apparent on the face of the record.
5. When these petitions came up for hearing we heard the counsel for the petitioner, perused the records and took up the petitions for orders.
6. Now the only point which arises for determination is as to whether there is any error apparent on the face of the record?
7. Point: All the cases are based on the allegation of deficiency of service and unfair trade practice by the builder Company who is the first opposite party in all the cases. Though the petitioner would claim that she is not a Director of the Company and there is nothing on record to connect her with the acts alleged, no evidence was tendered by her to support her claim. Delaying tactics was attempted by the opposite parties from the beginning itself and on perusal of the entire records in these 17 cases it could be seen that during the adjudication all the possible defences were made by raising the contention that the trial has to be kept in abeyance as proceedings are pending before the NCLT. Those contentions were repelled and the impugned order was passed. The matter involved in all these cases is cheating different persons by assuring dwelling places for them and after receiving consideration not providing the thing assured and not returning the cash received which is a grave issue. The records would reveal that this petitioner was also arrested on alleged act of deception. Even after pronouncement of the order attempts are being made to stay away from the liability towards the innocent clients which cannot be viewed lightly and the discretionary power of review can never be invoked in such matters.
8. In all the cases stereotype versions were filed and defended by the same lawyer. Here also the very same procedure is seen resorted to. Though the petitioner denied her connection with the first opposite party it could be seen that in the vakkalath filed by the petitioner in all petitions her address is shown as the "Director sales of Samson &Sons Ltd." which circumstance would work out against the plea of the petitioner that she has no connection with the first opposite party. For fastening liability in a proceedings before the Consumer Disputes Redressal Commission the standard of proof as in a criminal trial is not required. It is also significant to note that the petitioner did not tender any evidence to support her plea. The provision contained in section 50 of the Consumer Protection Act could be invoked only if there is an error apparent on the face of the record. Since in all these cases the review petitioner has been cited as one of the Directors of the Company, the order fixing liability on her cannot be found as a mistake.
9. On a perusal of the records in these cases this Commission is of the firm view that these applications have been filed only to protract the execution proceedings which may ensue against the culprits. We find no merit in these petitions. Point is found against the petitioner.
In the result, the petitions fail and we dismiss all these petitions.
