Let affidavit-of-service filed by the learned Counsel
appearing for the petitioner in Court today be kept on record.
The petitioner has filed the present writ petition for grant
of stage carriage permit with requisite fees for the route of
Purunia to Sealdah Station.
Mr. Bera, learned Counsel appearing for the petitioner,
submits that on 15th January, 2016, the petitioner made an
application with requisite fees for grant of stage carriage permit
in the route in question i.e. to say from Purunia to Sealdah
Station. No decision has been taken by the respondent no. 2,
State Transport Authority, West Bengal, in respect of petitioner's application.

Mr. Sanyal, learned Counsel appearing for the State, submits that if the petitioner's application has not been considered by the respondent authority then the respondent authority should be directed to consider and take a decision in respect of the petitioner's pending application.
Considering the submissions advanced by the learned Counsel appearing for the respective parties and after perusing the records, I direct the respondent no. 2, State Transport Authority, West Bengal, to consider and take a decision within 15th June, 2016 or in the first Board meeting of the State Transport Authority, West Bengal, after ensuing Assembly Election, whichever is earlier, after giving an opportunity of hearing to the petitioner or his authorized representative and thereafter communicate the decision to the petitioner within a period of two weeks.
With this direction, the writ petition is disposed of. There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities.
