Present petition has been filed under Section 428 of Code of Criminal Procedure, 1973 for quashing/setting aside of impugned order dated 29.03.2023 (Annexure P-5) passed in complaint case No.NACT/2112/2021 dated 17.02.2021(Annexure P-1) titled 'Godrej Agrovet Ltd. Vs. Aman Julaya Feed Store' under Section 138 of the Negotiable Instruments Act, 1881, whereby application moved by complainant/respondent herein for tendering fresh evidence by way of affidavit along with documents at post-summoning stage, was allowed.
2. When this Court showed its disinclination, learned counsel for petitioner seeks to withdraw the petition.
