Pursuant to the order dated 12.9.2012, report dated 29.10.2012 from the learned Additional District & Sessions Judge- V, Patna City, is available on record at flag 'A'. From a perusal of the report it appears that at that point of time the case was pending in his court at the stage of defence argument and the court estimated that the case was likely to be concluded by December 2012.

Today no one appears for the petitioner. It appears that the case must have been concluded by now on account of which learned counsel for the petitioner has stopped taking interest in the matter.

This application is dismissed.
