ORAL ORDER
2 03-11-20231. The present writ petition has been filed seeking the following relief(s):-
"1. That this is an application is for issuance of an appropriate writ order or direction to the respondents to grant the benefit of old Pension Scheme and GPF to the petitioners as they were recruited as constables pursuant to Advertisement 02/2004 and 03/2004 and 01/2004 in BMP-06, BMP-13, BMP-04, BMP- Patna High Court CWJC No.11445 of 2021(2) dt.03-11-2023 28/29 07, BMP-05, BMP-14, BMP-09, Saharsha District Force, Bhojpur District Force, STF, ATS, SPG and SDRF respectively and in the same transaction constables who were appointed in different districts force and BMP- 07 Katihar and BMP-12 Saharsha were granted old pension scheme and other benefit like GPF etc as cut-off date was fixed as 31.08.2005 but the case of the petitioners was delayed and they have been subjected to new Pension Scheme and CPF which is arbitrary, unreasonable and discriminatory as there is no fault of the petitioners in the delay made by the respondents in joining of the petitioners and in similar cases CWJC No- 8319/2020 and CWJC No-
24518/2018 and others this Hon'ble Court has been pleased to grant the said benefit to the petitioners of the said case and case of the present petitioners is similarly situated in fact squarely covered by the order of the said cases or for any other order or orders which this Hon'ble may deem fit and proper under the circumstances of this case."
2. After some arguments, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the respondent-authorities for redressal of their aforesaid grievances. Liberty so sought is granted.
3. In view of the aforesaid, the present writ petition Patna High Court CWJC No.11445 of 2021(2) dt.03-11-2023 29/29 stands disposed off.
