2. Rejoinder affidavit dated 17.10.2022 has been filed by the Applicants; the same is taken on record.
3. We have heard Mr. Biswambar Mohanty, learned Counsel for the Applicants, and Mr. Ashok Parija, learned Advocate General, Odisha, assisted by Ms. Saswata Patnaik, learned Additional Govt. Advocate appearing (in Virtual Mode) for State Respondents, Govt. of Odisha, Ms. Papiya Banerjee Bihani, learned Counsel appearing for Respondent No.3, Odisha State Pollution Control Board, Mr. Ashok Prasad, learned Counsel appearing for Respondent No.4, East Coast Railways, and Mr. Sanjay Upadhyay, learned Counsel appearing for Respondent No.5, M/s M. 4. This Original Application has been filed by the Applicants on the allegation that the Respondent No.5, M/s M. M. Logistics, is operating a coal dumping yard at Handapa Railway Station which is approximately 50 to 100 meters away from the village of the Applicants.
5. It is stated that due to operation of the coal dumping yard, the area is getting severely polluted and is also causing health issues to the villagers due to deposition of fly-ash. It is also stated that there are about six primary schools within a one kilometer radius from the Handapa Railway Station and the coal dust is affecting the small children.
6. It is further stated that the Consent to Operate which was granted to the Respondent No.5, M/s M. M. Logistics, was valid only upto 31.03.2021 and the same has not been renewed thereafter. It is also stated that the premises was inspected by the Odisha State Pollution Control Board on 25.11.2021, 29.11.2021 and 16.12.2021 and several non-compliances were observed during the inspections as a result of which a show cause notice was issued to the Railway Siding in question vide Board's letter dated 30.11.2021 and by an order of 24.12.2021, Consent to Operate which was granted upto 31.03.2024 has also been withdrawn.
7. Affidavit dated 28.06.2022 has been filed on behalf of the Respondent No.2, Collector-cum-District Magistrate, Angul, wherein it is stated that a strike was held on 30.12.2021 over the railway tracks of Handapa Railway Station by the Applicants who disrupted the movement of trains in view of their grievances relating to severe pollution and deposition of fly-ash in the area but 3 the strike was subsequently called off after intervention of the Tahasildar-Kishore Nagar.

The Odisha Pollution Control Board, Respondent No.3, has filed affidavit dated 27.06.2022, stating therein that Consent to Establish had been granted in favour of the Handapa Railway Siding vide Board's Office Memorandum No. 1234 dated 16.10.2019 and Consent to Operate was also granted vide Consent Oder dated 30.03.2021. It is stated that complaints were received by the Board, alleging pollution of air and water by the Railway Siding. Thereafter, an inspection and analysis was carried out of the air quality. Inspection Report of an inspection carried out on 25.11.2021 has been filed as Annexure-R/33 (colly) to the affidavit. The observations and recommendation in the Report read as under:-
"Inspection Report of M/s Handapa Railway Siding At -Handapa Railway Station, Handapa, Tahsil: Kishorenagar, Dist-Angul Observation on the day of inspection:
1. During visit on both days, railway siding was observed to be not in operation, no loading or handling of coal was observed at the railway siding area on either days. No coal was stacked over the platform of railway siding expect coal deposition on carpet area of the platform. However, stacking of coal was observed at two places beyond platform of railway siding, about 500-600 tonne of coal in the easternmost side of the railway siding and about 700- 800 tonne of coal in the southern side of the railway siding.
2. Boundary wall of height about 9ft using concrete slabs has been provided along southern side of the railway siding area. Screen barrier using synthetic cloth and bamboo as support was also being provided above boundary wall to prevent fugitive dust emission. Screen barrier were 4 provided in parts (about 100m0 only along the boundary wall.
3. Along northern side of the railway siding, no such provision of boundary wall/screen barrier/green barrier was provided. Railway authority may be asked to provide boundary wall and barrier along other side near to the habitation area.
4. No fixed type water sprinkling arrangements have been provided at the siding to control fugitive dust emission during coal handling. However, two tractor mounted water tanker (3KL each0 were found to be engaged at railway siding for water sprinkling on platform and approach roads.
5. Plantation along boundary wall of railway siding has been done, however, plantation along approach has not been done.
6. Dust deposition was observed on the approach and internal roads of the railway siding.
7. It was observed that approach road from railway over bridge (ROB) to the railway siding which is about 900m is damaged at some places.
8. No measures have been taken to prevent dust deposition in crop fields and human habitation located adjacent to the approach road. Railway authority may be asked to clean approach and internal roads on regular basis to avoid dust emission during playing of vehicles. Drain along approach road may be provided to check flow of dust into adjoining areas during monsoon or water sprinkling.
9. No surface run-of collection, treatment, disposal/reuse system has been provided at the railway siding. Although there was no wastewater discharge from siding or coal stacked areas to nearby water bodies or open areas observed during inspection, but there is possibility of flowing of contaminated surface run off into nearby nallah/open areas during monsoon period.
10. On 29.11.2021, Ambient Air Quality (AAQ) monitoring was conducted at in front of foot over bridge and water sample was collected from the Tarini Nallah which is flowing at about 20m away in the southern side of the railway siding. Analysis report of AAQ monitoring and water sample is enclosed separately.5
Recommendation:
The overall environmental compliances were not satisfactory. The aforesaid observation can be termed as sheer negligence on the part of the unit towards control of pollution. Action may be initiated against the railway siding for violating the consent conditions and causing environmental pollution."
9. The Ambient Air Quality (AAQ) report dated 09.12.2021 has also been filed at page no. 138 of the paper book, which shows the AAQ near Foot Over Bridge to be 73 i.e., it is within the prescribed standard of 100.
10. The water analysis report dated 09.12.2021 has also been at page no. 139 of the paper book, which also shows the parameters to be within the prescribed limit.
11. However, it is stated that on 30.11.2021 a show cause notice was issued to the Handapa Railway Siding with regard to the non-
compliances observed in the Inspection Report and thereafter the Railway Siding has filed its para-wise reply to the same vide letter dated 14.12.2021. The letter of the Railway Respondents dated 14.12.2021 is reproduced herein below in its entirety:-

Additional Information:
Due to the effects of the outbreak of Covid-19 pandemic, the Goods shed was being operated through temporary arrangements like water sprinkling through tankers, cleaning of siding area, developing greenery, mandatory tarpaulin cover over trucks.
Now, works of permanent infrastructure that are most critical to comply pollution control at Handapa Goods shed (i.e., boundary wall, permanent water sprinkling system, wheel wash system, dust screen wall and water arrangement) are being taken up for execution and the same is likely to get completed within a period of two months.

16. A perusal of this letter would show that after the notice was issued to the Railway Respondent, the permanent infrastructure works to comply with the pollution control at Handapa Goods Shed i.e., boundary wall, permanent water sprinkling system, wheel wash 8 system, dust screen wall and water arrangement, were taken up for execution and it is stated that the same were likely to be completed within two months. This letter of the Railway Respondent itself, therefore, shows that it had defaulted compliance of critical pollution control measures.
17. Thereafter, another inspection of M/s Handapa Railway Siding was carried out by the Odisha State Pollution Control Board on 16.12.2021. The observations and recommendation in the Inspection Report read as under:-

Recommendation:
Action/steps taken by the railway authority for compliance of issues raised in show cause notice was found to be inadequate and non-satisfactory. Unit has failed to comply the direction issued by the Board, therefore, stringent action such as revocation of consent order and issuance of closure direction may be initiated against the railway siding."
18. This Report shows that compliances were found to be inadequate and non-satisfactory and that the Unit had failed to comply with the directions issued by the Board such as -
(i) Coal stacked in the easternmost part of the Railway Siding beyond platform area has not been removed;

(ii) No steps had been taken for provision of boundary wall, screen barrier/green barrier along the northern side of the Railway Siding area near habitation;
(iii) Cleaning of approach and internal roads has not been done.
Dust deposition on these roads was observed during inspection;
(iv) No steps were observed to be taken for repair of approach road and to prevent dust deposition in crop fields and human habitation located adjacent to the approach road.
19. Accordingly, a notice dated 24.12.2021 under Section 31A of the Air (Prevention and Control of Pollution) Act, 1981, and under Section 33A of the Water (Prevention and Control of Pollution) Act, 1974, was issued to M/s Handapa Railway Siding to close down the operations of the said Railway Siding till removal of the defects pointed out in the show cause notice to the satisfaction of the Board.
20. Thereafter, another inspection of M/s Handapa Railway Siding was carried out on 19.04.2022 by the Board wherein certain observations were made in the Inspection Report which read as under:-
"Inspection Report of M/s. Handapa Railway Siding At-Handapa Railway Station, Handapa, Tahsil:
Kishorenagar, Dist-Angul Observation on the day of inspection :
1. During visit, railway siding was observed to be not in operation, no loading or handling of coal was observed at the railway siding area. No coal was stacked over the platform of railway siding except coal deposition on carpet area of the platform.11
2. It was verified from the records available with Station Manager, Handapa Railway Station that last rake for coal from railway siding was placed and loaded on 24.11.2021 and despatched on 25.11.2021 at 5.55AM.
3. It was observed that about 150-200 tonne of coal stacked at easternmost side of the railway siding beyond platform area of railway siding. No coal stacking in other area near railway siding was observed during inspection except carpet coal on an area at southern side of the railway siding beyond platform area.
4. No further development / improvement in non-
compliances/points mentioned in show cause notice issued by the Board vide letter No.3585, dt.30.11.2021 was noted during inspection."
21. The Respondent No.5, M/s M. M. Logistics, has filed its affidavit dated 22.08.2022, stating therein that this Original Application has been filed by the Applicants with malafide intention to stop the project of the Railway Siding for stacking and transporting of coal upto 80,000 MT/month.
22. Affidavit dated 22.08.2022 has been filed by the Respondent No.4, Railway Respondent, stating therein that the said Respondent has not allowed operating coal dumping yard at the Handapa Railway Station or adjacent to Handapa Goods Shed to the Respondent No.5, M/s M. M. Logistics.
23. The Respondent No.3, State Pollution Control Board, Odisha, has filed a further affidavit dated 19.09.2022 bringing on record the Inspection Reports of inspections carried out on 30.07.2020, 11.10.2019 and 14.09.2022. The observations and conclusion of the inspection carried out on 30.07.2020 read as under:- 12
"ENQUIRY REPORT ON COMPLAINT ALLEGED AGAINST DUMPING OF COAL NEAR HANDAPA RAILWAY SIDING LOCATED AT/PO-HANDAPA, DIST.ANGUL "OBSERVATIONS :-
1. During visit, no loading and unloading activity of coal through railway wagons and trucks was observed at railway siding.
Presence of coal was not observed at the platform of the siding. Only carpet coal was there. Besides, about 20 Ton to 30 Ton of Coal was stacked near railway siding in eastern corner of the platform.
2. The unit has submitted Gram Sabha Resolution copy along with no objection certificate from Handapa Gram Panchayat.
3. At about 1 km. distance from the Railway Siding towards Eastern side of the railway station about 1000 Ton of coal stacked was observed. It was enquired that, due to agitation of locals, the coal could not be despatched and temporarily stacked within the premises of Railway land.
4. As stated by Sri TapobantaSahu, Station Master of Handapa Railway Station that, loading and unloading activity of coal through Railway Wagons could not be started due to local issues.
5. As per the CTE special condition the Railway Siding should not use main road connecting from railway station to NH-42 road (through Market complex, school and human habitation) during transportation of coal. The unit has constructed separate shortest route from end of railway siding to NH-42 (Route map of railway siding is attached for reference) for transportation of coal from the nearest coal mine to railway siding through trucks.
6. The railway siding has constructed concrete boundary wall of length about 800m. with height about 9 ft. covering the entire railway siding area.
7. The unit has planted about 200 saplings adjacent to the boundary wall of railway siding.
8. The unit has made water sprinkling facility through tankers to avoid fugitive emission during loading and unloading activity. 13
9. Collector and District Magistrate, Angulhas allowed for loading and unloading of Coal from Handapa Railway Station with certain conditions vide his letter no. 1016 dtd. 12.06.2020. CONCLUSION :
As during visit no loading and unloading activity of coal through Railway Siding was observed hence the potential of air pollution and adequacy of pollution control measure being adopted at the railway siding could not verified. It will be verified after resumption of operation of railway siding."
24. The observations under the heads of 'Pollution Potential Solid Waste' and recommendation of the inspection carried out on 11.10.2019 read as under:-
"Inspection Report of M/s. Handapa Railway Siding At-Handapa Railway Station, Handapa, Tahsil:
Kishorenagar, Dist-Angul Pollution Potential:
Water:
Industry has proposed to utilise 2.0 m3/day of water for sprinkling (dust suppression) purpose.
Air:
The major source of air pollution at the railway siding is coal handling and vehicle movement. Unit has proposed to do water sprinkling/ permanent water sprinkling system for dust suppression. More than 50% of transportation road is concreted.
Solid Waste Management:
The major solid being generate will be the rejected coal fines. The unit has proposed disposed it in an environmentally sound manner.
Recommendation:
In the view of the above, online applications for Consent to Establish of the proposed railway siding may be considered.14
Subsequently the unit may adopt all pollution control measuring during stacking and transportation of coal."
25. The observations of the inspection carried out on 14.09.2022 read as under:-
"Inspection Report of M/s. Handapa Railway Siding At-Handapa Railway Station, Handapa, Tahsil:
Kishorenagar, Dist-Angul Observations made by the Board's official during inspection against the averments made in the Para 9 (a of
f) of the reply submitted by the Respondent No.5 are as follows:
a) Fixed type water sprinkling arrangements are in the process of being made. As an interim measure, multiples mobile water tankers with sprinklers have been provided.
Observation Fixed type water sprinkling arrangements were found to be installed along the boundary wall of the railway siding. 16 Nos. of nozzles (sprinklers) were installed for water sprinkling on internal road and platform (coal stacking) area of the railway siding. Apart from the fixed water sprinklers, one water tanker of 3KL capacity was also observed to be deployed at the railway siding for water sprinkling on roads.
b) A green belt has been developed all around the perimeter of the material storage and loading areas. Additionally, trees have been planted along the connecting road.
Observation Plantation has been done along either side of the boundary wall of the railway siding. Plantation activity along approach road and gap plantation along boundary wall of the railway siding was observed during inspection.
c) A boundary wall of 3 meters height has been constructed along the periphery of the mineral stack yard.
15 Observation Boundary wall using concrete slabs has been constructed along southern side of the railway siding which is about 700m long. Screen barrier using synthetic cloth and bamboo as support has also been provided above boundary wall to prevent fugitive dust emission.
Screen barrier above ground level has been provided along other side of the railway siding near to the habitation area. Screen barrier has also provided along approach road to prevent dust deposition on crop field.
d) An existing drain (in huge dilapidated condition) has been further improved all along the boundary wall of the Goods shed and the preparations for constructing a sedimentation tank to treat the wastewater are in process.
Observation One concrete drain using precast slabs was being constructed along the boundary wall of the railway siding. Construction of settling pits for collection, settling and reuse of surface runoff was under progress.
e) No coal is stacked anywhere on the Railway siding. However, at the time of its operation, it was ensured that storage was done with tarpaulin cover and water sprinkling arrangements were additionally in place to prevent dust deposition. Observation During visit, railway siding was observed to be not in operation, no loading or handling of coal was observed at the railway siding area. No coal was staked over the platform of railway siding except coal deposition on carpet area of the platform.
f) To prevent dust deposition on the approach road and the internal roads, sprinklers on tanks have been provided. Further, the Approach Road has been repaired and maintained to prevent dust generation due to plying of trucks. Observation As mentioned above, one tractor mounted water tanker of 3KL capacity has been deployed at the railway siding area for the 16 water sprinkling on approach road and internal roads. Approach road was also observed to be cleaned and repaired."
26. A perusal of the subsequent Inspection Report would show compliances of environmental norms and development of green belt, water sprinkling arrangements having been installed, construction of boundary wall using concrete slabs, screen barrier, construction of concrete drain, construction of settling pit for collection, settling and re-use of surface runoff water was found to be in progress. The report also mentions that no coal was stacked anywhere on the Railway Siding in question during the inspection carried out on 14.09.2022 and the Railway Siding was observed to be not in operation.
27. Though subsequent Inspection Reports mentions compliance of environmental norms and pollution control measures taken by M/s M.M. Logistics but so far as previous Inspection Reports are concerned, (already enumerated herein above), which have come on record in the affidavits of the Odisha State Pollution Control Board, the same clearly show violations of environmental norms by the said Respondent No.5.
28. The Applicants have filed rejoinder affidavit dated 17.10.2022, alleging that the environmental compliances were not satisfactory and there was negligence on the part of the Unit towards control of pollution. It is also stated that a direction may be issued to the Respondents to shift the coal dumping yard to some other place.
29. Be that as it may, as we have already noted herein above, that the previous Inspection Reports clearly show violation of environmental norms for which a show cause notice for closure has also been issued to the Railway Siding in question, the State Pollution 17 Control Board, being the Regulatory Authority, was expected to have computed the Environmental Compensation for previous violations and infractions of environmental norms but till date the same has not been determined and nothing has been filed in this regard by the Odisha State Pollution Control Board.
30. We, therefore, direct the Respondent No.3, Odisha State Pollution Control Board, to compute the Environmental Compensation against the Respondent No.5 for violation of environmental norms as noted in its previous Inspection Reports and the same shall be communicated to the concerned Respondent inviting his objections, if any, thereon. If the concerned Respondent files his objections, the Odisha State Pollution Control Board shall give him an opportunity of hearing on the same and thereafter pass final order determining the final Environmental Compensation in accordance with law within a period of one month. The final Environmental Compensation so computed shall be deposited by the Respondent No.5 with the Odisha State Pollution Control Board, within 15 days thereof.
