The revisionist was convicted by the trial court under Sections 452/324 of IPC and sentenced for one year simple imprisonment with a fine of Rs.1000/- under Section 452 IPC, for one year simple imprisonment under Section 324 IPC with a fine of Rs.1000/-. However, his appeal was partly allowed by the lower appellate court. He has been acquitted for the offence under Section 452 IPC and his conviction under Section 324 IPC has been affirmed. Hence, the present revision.
In compliance of this Court's order dated 14.07.2015, the revisionist is present in person before this Court who is duly identified by learned counsel for the revisionist. Vide order dated 14.07.2015, the revisionist was granted interim bail by this Court.
Heard learned counsel for revisionist on regular bail and perused the lower court record.
Learned counsel for the revisionist submits that revisionist was released on bail during the trial as well as in the appeal.
Considering the overall circumstances of the case, his interim bail is made absolute subject to the fact that he shall not misuse the same, the bail application No.1128 of 2015 is allowed.
Let the revisionist (Abdul Maroof) be enlarged on a regular bail in the aforesaid crime on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the Magistrate/ court concerned. It is made clear that the revisionist shall be permitted to extend the sureties of the same persons (who had earlier stood sureties for interim bail), but subject to their undertaking that it is now for the purposes of a regular bail. It is also made clear that fine imposed by the trial court shall also remain stayed.
List this matter after three weeks.
