S.C.B. MEDICAL COLLEGE AND HOSPITAL PROBLEMS Order No. (i) UNAUTHORIZED STALLS ADJACENT

281. TO THE BOUNDARY OF CARDIOLOGY 31.07.2025 DEPARTMENT AND LADIES HOSTEL:

On 19.06.2025, the learned Advocates' Committee has submitted a report mentioning therein that three nos. of unauthorized stalls are there adjacent to the boundary of Cardiology Department and Ladies Hostel and anti-social activities is going on there and the lady boarders residing in the hostel are suffering a lot.
Mr. Khilari Rishikesh Dnyandeo, I.P.S., D.C.P., Cuttack appearing through virtual mode has filed an affidavit dated 31.07.2025 stating therein that he has issued instruction to Inspector in-charge of Mangalabag P.S., Cuttack U.P.D. with copy to the Asst. Commissioner of Police, Zone-II vide office letter no.1060/DCP(OJC-Cell) dated 07.07.2025 & Memo No.1061/DCP(OJC-Cell) dated 07.07.2025 circulating order of this Court vide order no.252 dated 03.07.2025 for its implementation. It is further stated that the Inspector in-charge of Mangalabag PS Page 2 of 30 has submitted compliance report indicating action taken vide letter No.5009/MBG P.S. dated 29.07.2025 mentioning therein that three numbers of OPOLFED booths adjacent to the boundary of Cardiology Department and Ladies' hostel of SCBMCH, Cuttack have been evicted and now the place is free from encroachment. It is further stated that regular patrolling has also been intensified by the Mangalabag Police in that area round the clock by utilizing PCR, 112 and Medical OP staff to prevent anti-social activities as well as obstruction on the road. Due to presence of staff, security personnel of SCBMCH, Cuttack, at present, there is no hindrance found in that area. It is further stated that security guards have been deployed for frisking and checking thoroughfare to the Ladies' hostel. Apart from that, fencing & covering it with iron sheets has also been placed by the medical authority in front of the ladies' hostel so that the lady boarders residing in the hostel feel secured and live in a healthy environment without any hindrance. It is further stated that the Inspector in-charge of Mangalabag P.S and ACP Zone-ll has also been directed to keep sharp look over the matter and take stern action against the anti-socials who are creating hindrance in that area as well as in the periphery of SCBMCH, Cuttack. (ii) MAINTENANCE OF HYGIENIC CONDITION OF CENTRAL KITCHEN:
In the report dated 19.06.2025 of the learned Advocates' Committee, it was also mentioned that the state of Central Kitchen where the food is being prepared and supplied to the patients is far from satisfactory. As per the report, food is not being prepared in a hygienic manner thereby endangering the well-being of the patients and the Advocates' Committee presented photographs of preparation of roti manually for the patients.

Prof. Dr. Goutam Kumar Satapathy, Superintendent, S.C.B.M.C.H., Cuttack has filed an affidavit dated 29.07.2025, wherein it is stated the S.C.B.M.C.H., Cuttack is the premier hospital and tertiary Centre of the State having 2772 numbers of functional beds. However, surplus number of patients are being admitted and accommodated beside the beds and are being provided with medical services with diet facilities. The Indoor patients are being provided with cooked and dry diet thrice a day as per the indent received from different wards and departments. It is further stated that the dietary service has been outsourced. At present, the Page 4 of 30 outsourcing agency M/s. Utkal Suppliers, Berhampur has been providing the service of diet supply (both cooked food and dry food) to the indoor patients. As per the National Health Mission (NHM) guidelines, the agency has been provided with the space, electricity and water supply in order to facilitate preparation and distribution of diet to patients. It is further stated that the agency was instructed for preparation of roti by using machines to maintain proper hygiene. Accordingly, the outsourced agency has procured Jackson Roti Pressing Machine with ceramic coated plated with 3 conveyer belt roasting machine and the mechanical preparation of rotis has been started since 21st July, 2025. It is further stated that the Superintending Engineer, R & B, Division-I, Cuttack has been requested vide office letter No.16167 dtd. 15.07.2025 to take up the civil work for repair and renovation of the kitchen which is in progress. Furthermore, the R & B Department has also been requested to take necessary measures for rodent control in the kitchen which will be taken up after completion of civil work and electrical works. The whole exercise of the work is likely to be completed by the end of August, 2025. It is further stated that a meeting of Diet Vigilance Committee of S.C.B.M.C.H., Cuttack has also been convened on Page 5 of 30 04.07.2025 wherein certain decisions were taken in order to achieve the goal of maintaining hygienic condition in the kitchen and improving the efficiency of dietary work. The affidavit is taken on record.

The video clipping of the Central Kitchen was displayed in Open Court. On seeing the display of the preparation of the rotis, it is noticed that proper hygiene is not being maintained inasmuch as the persons collecting the rotis are not using gloves and most of them do not have any cover on their head and mouth and people with shoes are being allowed inside the Central Kitchen.

Prof. Satapathy, Superintendent, S.C.B.M.C.H., Cuttack assures this Court that he will look into this aspect and ensure that proper hygiene is maintained in the process of making rotis.

Accordingly, steps taken shall be reviewed by the Advocates' Committee on its next visit i.e. on (02.08.2025) and they will submit a report in this respect.

(ii) LIVER TRANSPLANTATION ISSUE

282. A news item has been published in Odia 31.07.2025 daily "The Samaja" on 10.07.2025 that liver transplantation cannot be held further in SCBMCH, Cuttack.

On 18.07.2025, by order no.266, this Court has taken on record the instruction submitted by the Medical Superintendent, SCBMCH, Cuttack regarding liver transplantation and one of the points, which was specifically stated in the said instruction, which is germane for today's deliberation is "No patient has been deferred, delayed for liver transplant fulfilling the pre-transplant criteria in the meantime".

A news item published in Odia daily "The Sakala" dated 31.07.2025 has been brought to the notice of this Court under the caption of "DOSA KHASEIBAKU SCB RA UDYAMA, MRUTYU PARE AIG KU CHITHI", which is taken on record.

Learned Addl. Govt. Advocate appearing for the State seeks a short adjournment to obtain instruction in the matter.

The D.M.E.T. and Mr. Umakant Satapathy, Addl. D.M.E.T and Nodal Officer for Organ Transplant are present virtually stating that proposal for entering into MoU with MGM, Chennai for undergoing Page 7 of 30 liver transplant is pending at the Govt. level.

Taking into account this liver transplantation (s) is very crucial and cannot be deferred indefinitely, this Court fervently hopes that expeditious steps in this regard shall be taken and timeline shall be provided as to when the Govt. approval would be granted and the transplantation process would commence.

In the interregnum, the Govt. shall also explore the possibility of continuing with the earlier arrangement with AIG, Hyderabad so that interest of the patients is not hampered.

An affidavit in this regard shall be filed by 05.08.2025 and the matter shall be taken on 07.08.2025.

The affidavit shall specifically deal with the allegations as levelled in the news item, which has been taken on record and it should also indicate as to how many persons seeking liver transplantations are pending consideration on the date of filing of the affidavit and disposal of such applications within the period of last three months. Along with the affidavit, the minutes of the Authorization Committee of SCBMCH, Cuttack relating to liver transplant qua the last six months shall be placed on record.

The Addl. DMET, who is the Nodal Officer for Organ Transplant on the query of the Court submits that each hospital, who is undertaking transplantation has its own Authorization Committee and the minutes of the said Committee are not endorsed to the DMET.

(iii) CARDIO THORACIC VASCULAR SURGERY AND ECMO UNIT OF CARDIOLOGY DEPARTMENT:

283. The issue relating to the Cardio Vascular 31.07.2025 Surgery and ECMO Unit of Cardiology Department is taken up and the learned Amicus Curiae along with the President and Secretary of the Orissa High Court Bar Association have submitted a memo highlighting the deficiencies and also suggested remedial measures. The issues and suggestions are culled out hereunder:
"Issues:
1. For the first time instruments and equipment's procured for open heart surgery in the year 1985 and thereafter Page 9 of 30 in the year 2015. (after 2015 there was no supply of major and vital instruments and equipment's despite repeated communications and requests made by the Head of the Department and there is acute shortage of man power both in Cardio Thoracic Vascular Surgery and ECMO Unit of Cardiology Department).
2. There are lack of most vital equipment's and instrument's in the Cardio Thoracic Vascular Surgery and ECMO unit of Cardiology Department such as HEART LUNG MACHINE, HEART COOLER MACHINE, INTRA AROTIC BALOON PUMP, DUAL CHAMBER PACE MAKER ETC.
3. That the list of equipment's and instruments required has been placed since the financial year 2017-2018 but till date no instruments have been supplied to the department.
4. That for example there is availability of one Heart lung machine, one heater cooler machine and one dual chamber pace maker, in the event one of the Page 10 of 30 machine becomes non- functional during operation, the patient will die, as there is no backup.
5. That it is pertinent to mention here that, the Open heart surgery is being done only at SCB Medical College & Hospital Cuttack only as state institute. Suggestion:
That the machineries, equipment's and instruments which are available in the Cardio Thoracic Vascular Surgery and ECMO unit of Cardiology Department in a singular number, be provide to the department immediately.
That it is seen from the reports of state opposite parties that, because of single tender issue on many occasion, the machineries, equipment's and instruments could not be supplied in time.
That there should be a high Power committee to deal with such emergent issues and there shall be wavier clause to authorize appropriate authority to place order or indent for necessary purchases, because for holding a Page 11 of 30 meeting of high Power committee it also consumes much time or any appropriate action be taken for this purpose."

A copy of the memo along with all the annexures has been served on Mr. Nayak, learned counsel appearing for the State, who is requested to obtain instruction relating to the same.

Let an affidavit be filed by the Superintendent I/c SCBMCH, Cuttack addressing these issues raised and response to their suggestions.

The affidavit shall be filed on or before 14.08.2025 and the matter be listed on 21.08.2025.

(S.K. Sahoo) Judge (V. Narasingh) Judge SARDAR VALLABHBHAI PATEL POST GRADUATE INSTITUTE OF PAEDIATRICS (SISHU BHAWAN)

284. (i) As per order no.230 dated 09.01.2025, 31.07.2025 when it was brought to the notice of this Court that access to Sishu Bhawan from Ring Road side is impeded because of unauthorized vending, it was directed that the steps shall be taken to make the Page 12 of 30 access hindrance free.

          Today,         Mr.      Pravakar            Mishra,
Superintendent,    SVPPGIP,     Cuttack      has    filed   an

affidavit dated 31.07.2025. Paragraph no.3 thereof reads as under:

"3. That, in compliance of Court order dated 03.07.2025, the debris from the river side main gate is being regularly cleared by the Executive Engineer (R & B), Division No.1, Cuttack. The fixation work of steel gate and dismantling work of old existing building have been going on and the same will be completed by the end of August, 2025.
4. That, in compliance of Court order, the Cuttack Municipal Corporation, Cuttack has removed the unauthorized shops at ring road side main gate of SVPPGIP, Cuttack."

The affidavit is taken on record.

(ii) In connection with G+6 Multi Utility Hospital of SVPPGIP, Cuttack, Today, Mr. Mishra, Director, SVPPGIP, Cuttack is present through online has filed an affidavit dated 31.07.2025 wherein it is stated that the administrative and academic blocks at 5th and 6th floor of G+6 hospital building have been shifted and are fully functional from 10.02.2025. The OPDs (Pediatrics & Pediatric Page 13 of 30 Surgery) and Casualty have been fully functional in the ground floor of new G+6 hospital building with effect from 15.02.2025. It is further stated that the pediatric wards have been fully functional with effect from 25.02.2025. All the modular OTs at 4th floor of new G+6 hospital building have been completed and taken over by the Superintendent, SVPPGIP, Cuttack on 09.06.2025 and the same will be functional after installation of Pediatric OT table and CSSD and in this regard, a letter has already been sent to the Managing Director, OSMCL, Odisha, Bhubaneswar for supply of Pediatric OT table and CSSD vide office letter no.4203 dated 29.07.2025. It is further stated that the pediatric surgery ward has been fully functional at 4th floor of new G+6 hospital building and the 114 bedded new born ward of Pediatric Department are fully functional at 3rd Floor of G+6 hospital building.

(iii) As per the order no.253 dated 03.07.2025, the Superintending Engineer, R & B Division, Cuttack was directed to file an affidavit regarding the status of 200 bedded (G+5) patient attendant rest shed inside SVPPGIP, Cuttack and steps taken against the errant contractors and officers, who are supervising the construction work and place on record the plan of action to see that Page 14 of 30 there is no recurrence of such occurrence.

Md. Shahbaz, Superintending Engineer, R & B Division No.1, Cuttack is present through online has filed an affidavit stating therein that the Contractor was issued show cause notice about occurrence of mishap in the premises of SVPPGIP (Sishu Bhawan) on 25.06.2025 and they were instructed to rectify the defect which led to collapse of parapet wall on the 2nd floor (left side front elevation) of the hospital building as per condition of contract clause 34.1 which reads as under:

"The Engineer shall give notice to the contractor of any defects before end of Defect liability period, which begins at the completion & is defined in the contract data. The defect liability period shall be extended as long as defects remain to be corrected".

Moreover, as per conditions of contract Clause 34.2, "Every time notice of a defect is given, the contractor shall correct the notified defect within the length of time specified in the Engineer's notice."

It is further stated that again, the contractor has been served show cause notice-II on 19.07.2025 and warned that the Bank Guarantee amounting to Rs.5,84,60,550/- (Rupees Five Crores Eighty Four Lakhs Sixty thousand five hundred fifty) Page 15 of 30 only will be forfeited. It is further stated that the work "Construction of Multi-Utility Complex and P.G. Students Hostel at Sardar Vallav Bhai Patel Post Graduate Institute of Paediatrics (SVPPGIP), Sishu Bhawan, Cuttack in the State of Odisha on Turnkey basis" was awarded to M/s. Bridge & Roof Co. (India) Ltd. (the Contractor) vide Agreement No.SBD-01 of 2018-19. The contract period was for 2 years i.e. from 27.02.2019 to 26.02.2021 followed by three years, of defect liability period. The agency has completed the work on 31.12.2022. Thus defect liability will continue until 31.12.2025. One cement structure of length 20 ft. width 0.5 ft. and height 2.00 ft. was constructed to the front of the chaza connecting the 2nd floor portico and the 3rd floor portico for beautification of the building. Due to heavy rainfall in the afternoon of 25.06.2025, the cement structure on the eastern front of the building collapsed and fell on the ground damaging a few two-wheelers. It is further stated that similar cement structures at the other end for beautification were also removed immediately. The approximate cost of the cement structure was Rs.80,000/- (rupees eight thousand). Since the damage was caused during defect liability period, the restoration cost will be borne by the agency. Soon after the present Page 16 of 30 accident, a thorough checking of the building has been undertaken and any defect to structural safety of the building noticed during inspection will be rectified by the agency and the defect liability period may be extended if necessary. It is further stated that one M/s. SM Consultants was awarded supervision of the construction work of Multi-Utility Complex and P.G. Students Hostel at SVPPGIP, (Sishu Bhawan) on turnkey basis vide Agreement No.1630 P1 of 2018-19 with date of commencement as 02.03.2019 and the stipulated date of completion as 01.03.2021. The supervision consultant was issued show cause notice on 19.07.2025 mentioning serious lapse on its part pertaining to supervision of above mentioned work during construction stage. As per section 6 of RFP Clause 3, the objectives of supervision consultants' services are (i) to ensure that high quality construction is achieved and to ensure that all works are carried out in hill compliance with the engineering design, technical specification & other contract documents with in stipulated time period and (ii) to demonstrate the efficacy of contract supervision by independent external agencies experienced in this field of work. It is further stated that as regards action against the erring officials, notice to show-cause to the Page 17 of 30 concerned officers as to why appropriate action shall not be taken for negligence in undertaking due supervision work of the (G+6) Sishubhawan Building work has been issued on 28.07.2025. So far as construction of 200 bedded patient attendant res shed at SVPPGIP (Sishu Bhawan) is concerned, it is mentioned in the affidavit that Rs.12,09,16,000/- (rupees twelve crores nine lakhs sixteen thousand) was accorded by the Health & Family Welfare Dept., Govt. of Odisha vide letter no.23525 dated 22.09.2023 and the technical sanction by Chief Engineer (Buildings-I), Odisha on 30.01.2025 amounting to Rs.11,35,62,429/- (rupees eleven crores thirty five lakhs sixty two thousand four hundred twenty nine) with construction period of eighteen calendar months. It is further stated that DTCN & BOQ has been approved by the Chief Engineer (Buildings-I), Odisha. Accordingly, tender was invited vide Letter No.4124 Dated 30.01.2025 and Bid Identification No.CE(B)-30/2024-25 with bidding period allowed from 10.02.2025 to 25.02 2025 (15 days). However, the tender was cancelled on administrative ground. The second tender was invited vide Letter No.12708 dated 27.03.2025 with bidding period allowed from 03.04.2025 to 19.04.2025. Technical bid (Cover-1) of the bidders Page 18 of 30 were opened on 21.04.2025 and accordingly, 16 bidders have participated in the online tender. At present, technical evaluation of the above bidders are being scrutinized by the office of the Chief Engineer (Buildings-I) and the tender will be finalized and agreement will be drawn by 30.09.2025 for execution of work. The said affidavit is taken on record.

Md. Shahbaz, Superintending Engineer, R & B Division No.1, Cuttack submitted that after collapse of the second floor of the SVPPGIP, Cuttack, an inspection was conducted on 25.07.2025 and the present structure is safe in all respects.

He is called upon to file an affidavit in this regard indicating the names of the officers, who are part of the inspecting team on 25.07.2025. The affidavit should be filed on or before 04.09.2025.

During visit of the Sishu Bhawan by the learned Advocates' Committee on 19.06.2025 at 4.45 p.m., they found the following lacuna, which are as under:

"..........
2. That in and around the old residential quarters of doctors and staffs there exists much garbage and the surrounding was not at all Page 19 of 30 hygienic.
3. That the casualty functioning in the new building is very small and have only one bed, in the event two or more serious patient's comes at a time they cannot be accommodated.
4. That the vehicles and two wheelers are being parked in front of the main building, and that the auto and two wheelers are moving freely which is a big concern, as the children and their parents used to move one place to other by walking.
5. There is no CCTV surveillance in and around casualty.
6. That there is no boundary wall in the backside of the Sishu Bhavan."

The suggestions made by of the learned Advocates' Committee are extracted below:

"SUGGESTIONS:
i. Since the patient's attendants have to travel for about 200 meters for washroom, two wash rooms are to be constructed inside / near the attendant shed one for women and another for men and the windows should be Page 20 of 30 covered by netting mesh.
ii. That the old residential quarters of doctors and staffs and the surrounding should be cleaned regularly. iii. That the casualty functioning in the new building should have at least four beds and other ancillary facilities including A.C. iv. That there exists more space at the left side of the new entrance gate, so parking of vehicles as well as two wheelers can be done by making appropriate arrangement like parking shed so that there will be no rush near the casualty, ticket counter and medicine counter of the new building.
v. That four numbers of battery vehicles be deployed for movement of patients and their attendants at the entrance gate to avoid vehicular rush. vi. That the entire campus should be kept under CCTV surveillance for the safety and better interest. vii. A permanent boundary wall should be constructed covering the entire campus."

The report submitted by the learned Advocates' Committee is taken on record. A copy of the same has also been served on the learned counsel for the State, who seeks some time to obtain instruction on the same.

List this matter on 11.09.2025.

OPEN POND IN SISHU BHAWAN It is brought to the notice of this Court that there is an open pond without any barricade in front of the OPD and there is apprehension that some untoward incident may take place.

The Superintendent, SVPPGIP (Sishu Bhawan), who is present online brought to the notice of this Court that communication has been addressed to the R & B Division, Cuttack to take adequate safety measures in this regard.

Md. Shahbaz, Superintending Engineer, R & B Division No.1, Cuttack assures this Court that steps shall be taken to address this issue and the progress in this regard shall be intimated to this Court on its next sitting i.e. on 07.08.2025.

MOVEMENT OF VEHICLES INSIDE SISHU BHAWAN:

Regarding free and safe movement of patients, doctors and attendants in SVPPGIP (Sishu Page 22 of 30 Bhawan), the Superintendent, SVPPGIP Prof. Prabhakar Mishra submits that new gate is yet to become operational. And, once the same becomes operational, they will put in place the mechanism by which the vehicles will not be allowed beyond the gate and the patients will use battery cars provided by the Sishu Bhawan to go to the respective departments save and except those who need emergent treatment, whose vehicles/ ambulances will be allowed to go inside.
List this matter on 16.10.2025.
(S.K. Sahoo) Judge (V. Narasingh) Judge ISSUES RELATED TO TALADANDA CANAL:
285. (i) BEAUTIFICATION AND 31.07.2025 EXPANSAION OF TALADANDA CANAL:
As per order No.254 dated 03.07.2025, the M.D., OCCL, Cuttack was directed to take necessary steps to remove the stacked materials from both sides of canal embankment.
Learned counsel for the CMC submits that in compliance of the aforesaid order, the following steps have been taken which are extracted below:

"1. Regarding clearance of garbage in front of the Urban Hat so also in the vicinity and in and around of the Box Drains as has been reported in the news item, it is stated here that, 03 nos. of vats/pots have been constructed and facilitated at that site for temporary stacking of garbage which is being lifted on daily basis. It is pertinent to mention here that, 25 nos. of personnel, i.e. Sweeper- 16 nos., Loader- 4 nos., Driver- 2 nos. and Security Personnel- 3 nos., have been provided to the Urban Hat for sweeping and transportation of garbage.
2. Further, the Paver blocks have been completed to the extent of 75% of the total assigned length. However, it is seen that the beautification and expansion work of Taladanda Canal is being progressed slowly by the executing Agency, i.e. Engineering Projects India Limited (EPIL), A Govt. of India Enterprise, Flat No.-201, Plot No.-
109, Unit-VI, Surya Nagar, Bhubaneswar. Hence, a reminder vide Page 24 of 30 CMC Letter No.-7268 (PW) dated 10.06.2025 has been issued to the Executive Director, EPIL to expedite the said work, otherwise the work order will be cancelled and a fresh tender will be invited for the said purpose."

Further progress made in this regard shall be placed before this Court on 23.10.2025.

(ii) BEAUTIFICATION OF TALADANDA CANAL

286. As per the order no.272 dated 18.07.2025, 31.07.2025 the D.C.P., Cuttack was directed to take action against miscreants defacing the Taladanda Canal in the face of repeated directions passed by this Court.

The DCP, Sri Khilari Rishikesh Dnyandeo, IPS, who is present virtually, submits that immediate steps have been taken against the miscreants who are trying to deface the beautification of Taladanda Canal and he assures this Court that further precautionary measures as deemed fit shall be taken Page 25 of 30 in this regard. He is requested to file a compliance affidavit by the next date.

287. As per order no.192 dated 30.10.2024, Mr. 31.07.2025 Nayak, learned counsel for the CMC submits that request letter has been issued to the Director, Tourism, Government of Odisha in this regard to provide proper lighting system within the Boat Club Complex. Hence, he is requested to file an affidavit in this regard by the next date.

                       (iv)    WIRE        MESH     FENCING       AND
                       DAMAGE FOOTPATH ON BOTH SIDES
                       OF TALATANDA CANAL:
   288.                In     compliance    of     the   order    dated
31.07.2025

16.05.2025 with regard to wire mesh fencing and Page 26 of 30 damage footpath on both sides of Talatanda Canal, the following steps have been taken by the CMC which are extracted hereunder:

"The Wire Mesh Fencing works of all the 08 nos. of bridges of Taladanda Canal have been completed and signboards have been displayed at prominent places for the public with a message "Not to Throw Garbage into the Canal".

The work is going on, but the same has not yet been completed. In this connection, it is pertinent to mention here that, the work has been assigned to the Engineering Projects India Limited (EPIL), A Govt. of India Enterprise, Flat No.-201, Plot No.-109, Unit-VI, Surya Nagar, Bhubaneswar.

However, it is seen that the beautification and expansion work of Taladanda Canal is being progressed slowly by the said Agency, i.e. EPIL. Hence, numbers of letters including the last issued reminder vide CMC Letter No.-7268 (PW) dated 10.06.2025 have been issued to the Executive Director, EPIL to expedite the said work, Page 27 of 30 otherwise the work order will be cancelled and a fresh tender will be invited for the said purpose.

As per last discussion with EPIL Officials, he has assured to complete the Footpath by 31st August, 2025."

Learned counsel for the CMC is requested to file compliance affidavit by the next date.

289. As per order no.259 dated 03.07.2025, 31.07.2025 the learned DSGI and learned counsel for the CMC were called upon to file affidavits regarding compliance of the earlier direction of this Court dated 12.12.2024 and the DCP Cuttack should intensify the patrolling to ensure that there is no untoward incident in and around Satyabrata Stadium.

In compliance of the said direction, the following steps have been taken which are extracted hereunder:

"Regarding trimming of trees inside Satyabrata Stadium, it is humbly Page 28 of 30 submitted that, the same is being undertaken by CMC as and when necessary.
Cleaning staff are being provided by CMC for cleaning the inside area of Satyabrata Stadium to keep the stadium garbage free.
All the Street Lights have been provided by CMC and all are functional.
Apart from these, all other issues related to Satyabrata Stadium lies with Archaeological Survey of India (ASI)."

So far as other issues relating to steps taken by ASI, Mr. P.K. Parhi, learned DSGI is called upon to file an affidavit by the next date.

290. During the course of hearing, while dealing 31.07.2025 with the issue of traffic light, it came to fore that on the basis of communication of DCP, Cuttack, steps have already been taken for procuring the Cameras.

The DCP, Cuttack states that he had also requested the CMC for installation of traffic lights.

It is brought to the notice of this Court that the CMC Commissioner is also the Vice- Chairman of CDA.

Learned counsel appearing for the Cuttack Development Authority undertakes to file an affidavit clarifying the position.
