LPA No. 104 of 2020 in CWJC No. 18612 of 2019 with LPA No. 60 of 2020 in CWJC No. 18612 of 2019 In these batch of LPAs, first LPA No. 104 of 2020 is distinguishable to the extent that first LPA No. 104 of 2020 appellant who is not party in the writ application No. 18612 of 2019. In view of these facts and circumstances question for consideration is whether first LPA No. 104 of 2020 is maintainable or not?

Learned counsel for the appellant Mr. P.K. Shahi vehemently submitted that LPA is maintainable even though the appellants are not party to the writ application. In support of the aforesaid contention, he relied on Apex Court decision in Ram Patna High Court L.P.A No.104 of 2020(14) dt.16-11-2022 20/27 Janam Singh reported in AIR (1994) SC 1722 (Para 8) and further submitted that in number of cases LPA bench of this Court has entertained even though concerned appellant was not party to the writ application.

Heard learned counsel for the appellants in first LPA No. 104 of 2020. LPA is not maintainable by the appellant Mr. Rabindra Prasad for the reasons that he is not party to the writ application.

Apex Court in the case of Shivdeo Singh & Ors. Vs State of Punjab & Ors. reported in AIR 1963 (SC) 1909 wherein the principle of entertaining writ/appeal against the order passed in writ petition is maintainable or not? Apex Court in the Shivdeo Singh(supra) case, it is held that appeal against the writ order is not maintainable in the event of appellant is not party to the writ petition. The cited decision in the case of Ram Janam Singh Vs. State of U.P. reported in 1994 AIR 1722 (para 8) reads as under:

"8. The appellant, admittedly, was not impleaded as a party to the said writ application, but as he is directly affected like many other officers, who had entered into the State Civil Service before the respondent, filed the connected Special Leave Petition, challenging the validity of the judgment aforesaid. In view of the fact that the appellant had entered into Civil Service of the State Government before the respondent, Patna High Court L.P.A No.104 of 2020(14) dt.16-11-2022 21/27 it is not in dispute that he is affected in the matter of seniority by the impugned judgment. It was held by this Court in the case of Prabodh Verma v. State of Uttar Pradesh, AIR 1985 SC 167 : (1984) 4 SCC 251, that a writ application in which the necessary parties likely to be affected have not been impleaded, the High Court should not proceed with such writ application, without insisting, on such persons or some of them in representative capacity being made respondents. It was further held that if petitioner refuses to join them, the High Court ought to dismiss the petition for non- rejoinder of necessary parties. Admittedly, none was impleaded even in a representative capacity. But it can be urged on behalf of the respondent that he had not sought any relief against any individual. He had sought the intervention of the High Court to declare Rule 3(1) of 1973 Rules and Rule 3(b) of 1980 Rules as ultra vires, so far they made applicable the benefit of those rules to only specified class of persons and restricted to others who were similarly situated. As such respondent was not required to implied private respondent, who might be affected by the verdict of the Court. Even if this stand is accepted, can it be said that persons who have been affected by the judgment of the High Court in the connected writ application cannot challenge the correctness thereof either by filing a Review Petition before the High Court or by filing a Special Leave Petition before this Court? According to us, the answer is in negative. The appellant has a locus standi to challenge the said judgment, although he was not party to the same and the Special Leave Petition filed on his behalf cannot be rejected on that ground. The delay in filing the Special Leave Petition has also been fully explained in the facts and circumstances of the case, which is condoned."

Patna High Court L.P.A No.104 of 2020(14) dt.16-11-2022 22/27 The cited Ram Janam Singh is not applicable to the case in hand for the reasons that appellant in Ram Janam Singh was not party to the writ Court/appeal before High Court, on the other hand, Apex Court has entertained SLP to that effect it is distinguishable.

Moreover, it is to be noted that scope of appeal against the order of learned Single Judge is very limited whether learned Single Judge has committed error with reference to records or not? On the other hand, scope of writ petition is wider so as to rise all the contentions. In fact, filing of writ petition and seeking recalling of the learned Single Judge order by person who is not party to the writ petition would be advantage. Otherwise scope of filing LPA and addressing arguments would be restricted to the extent that what is error committed by the learned Single Judge. In other words once again all the contentions cannot be addressed.

In the light of these facts and circumstances, the appellant in LPA No. 104 of 2020 stands rejected on the score that LPA is not maintainable against the order of the learned Single Judge for the reasons that appellant was not party to the writ application no. 18612 of 2019.

Patna High Court L.P.A No.104 of 2020(14) dt.16-11-2022 23/27 Accordingly, LPA stands dismissed reserving liberty to the appellant to invoke writ jurisdiction under Article 226 of the Constitution.

LPA No. 121 of 2020 Pursuant to the order of this Court dated 18.12.2019 passed in CWJC No. 18612 of 2019 District Magistrate, Gaya proceeded to terminate the services of the appellant and others on 24.12.2019.

Feeling aggrieved by the order of termination/removal appellant and others filed CWJC No. 2109 of 2020 and it was decided against the appellant on 31.01.2020, hence the present LPA.

Learned counsel for the appellant vehemently contended that their selection and appointment is in accordance with law. It is also submitted that District Magistrate, Gaya should have preferred LPA against the order passed in Kapil Kumar case in order to defend the action of selection and appointment of appellant and others, pursuant to the advertisement 31.12.2013. It is also submitted that before terminating/removal order dated 24.12.2019, the appellant and others have not been heard in the matter. The learned Single Judge has not appreciated the aforesaid factual aspect of the Patna High Court L.P.A No.104 of 2020(14) dt.16-11-2022 24/27 matter and proceeded to dismiss the appellants CWJC No. 2109 of 2020 while upholding the order of termination/dismissal dated 24.12.2019.

Perusal of the records, it is evident that in all fairness appellants should have provided an opportunity of hearing before termination/removal of the order dated 24.12.2019, even though District Magistrate, Gaya has implemented order of the learned Single Judge passed in Kapil Kumar case in CWJC No. 18612 of 2019 decided on 18.12.2019. In fact, in the case of Kapil Kumar the appellants were necessary and proper parties for the reason that learned Single Judge while passing order in Kapil Kumar case passed adverse order against the selection and appointment of the appellants. Against the order of the Kapil Kumar case both appellant and State have slept over their rights. However, District Magistrate, Gaya while passing orders of termination/removal dated 24.12.2019 has not given an opportunity. In the light of these facts and circumstances orders dated 24.12.2019, 01.01.2020 and order dated 31.01.2020 passed in CWJC No. 2109 of 2020 are set aside. Order of termination/removal is not a detailed speaking order in such circumstances District Magistrate, Gaya is hereby directed to Patna High Court L.P.A No.104 of 2020(14) dt.16-11-2022 25/27 issue a fresh detailed show-cause notice as to why the appellant services shall not be terminated/removed in the light of Kapil Kumar case, if such detailed show-cause notice is issued, the appellant and others rights are likely to be affected should submit their explanation in detail, within a period of four weeks from the date of receipt of notice to be issued by the District Magistrate, Gaya. On receipt of appellants and similarly situated persons who have furnished their explanation to the show-cause notice those explanation shall be considered in detailed with reference to various policy decisions in respect of filling of Group D post in district Gaya. Each of the contention to be risen by the appellant and others in their explanation is required to be examined with reference to relevant rule governing the post of Group D read with advertisement dated 31.12.2013, select list and order of appointments. So as to whether process of selection and appointment to the Group D pursuant to the advertisement dated 31.12.2013 read with the select list and order of appointment issued to the respective parties are in order or not? If their selection and appointment are in order, in that event fresh order of appointment shall be issued while counting the past service for all service benefits except monetary benefits during the period from 24.12.2019 till order of appointment, if Patna High Court L.P.A No.104 of 2020(14) dt.16-11-2022 26/27 any, to be issued in favour of the appellant and similarly situated persons.

The contesting respondents were also permitted to submit their say in the matter as to how appellants are not entitled to selection and appointment. In this regard, District Magistrate, Gaya is hereby directed to examine whether the contesting respondents have locus in so far as questioning the selection and appointment of the appellant and similarly situated persons or not? On this point also the speaking order to be passed by the District Magistrate, Gaya must reveal as to how District Magistrate, Gaya has considered the version of the contesting respondents the above exercise shall be completed within a period of six months from the date of receipt of this order. Before that whatever the observation made by the learned Single Judge in CWJC No. 2109 of 2020 would not come in the way of passing speaking order. In the result LPA is allowed in part.

At this juncture, learned counsel for the appellant vehemently contended that Kapil Kumar judgment is required to be taken note of for the purpose of interference. The same cannot be examined in the present LPA for the simple reason that there is no challenge to the order passed in the case of Kapil Patna High Court L.P.A No.104 of 2020(14) dt.16-11-2022 27/27 Kumar in particularly order dated 18.12.2019 passed in CWJC No. 18612 of 2019.

LPA No. 126 of 2020 Relist LPA No.126 of 2020 on 17.05.2023.

LPA No. 206 of 2021 LPA No. 206 of 2021 is required to be examined only as and when District Magistrate, Gaya take appropriate action pursuant to the LPA No. 104 of 2020 decided today.
