The petitioner has filed the present writ petition seeking direction to the respondents to pay the amount of GPF which has been sanctioned to her late husband.

The husband of the petitioner was working in the Education Department. He died on 19/09/2009 and even after his death, the respondents have not paid the amount of GPF, miss credit, arrears of 5 th pay commission to the petitioner. The petitioner submits that she submitted number of representations to the respondents but no action has been taken in the matter. She, therefore, prays that the writ petition be disposed of with direction to the respondents to consider her case for grant of GPF and other retiral dues.

Learned Panel Lawyer has no objection if such direction is issued. In the light of the aforesaid submissions, the writ petition is disposed of with direction to the respondents to take necessary action on the representation submitted by the petitioner within a period of 60 days from the date of receipt of certified copy of the order passed today. It is made clear that if the petitioner is found eligible, then the amount be released to the petitioner forthwith. If any delay is caused by the respondents in paying the amount to the petitioner, then the petitioner is entitled to get interest @ 8% per annum.

With the aforesaid observations, this writ petition is disposed of. Certified copy as per rules.
