Mr. Nanja Reddy P.N. Adv. for Petitioner Mr. A.M. Suresh Reddy, AGA for Respondents

1. Against the impugned Show Cause Notice Annexure-G dated 19.06.2017 issued by the 2nd Respondent-Deputy Commissioner of Excise, Tumkur, the petitioner has already filed the reply/representation vide Annexure-H dated 23.06.2017.

2. The said Show Cause Notice is yet to be decided by the concerned Authority of the Excise Department. Therefore, it would be premature for this Court to express any opinion on the merits of the contentions raised by the petitioner before this Court and hence, the petition is disposed of with a liberty and direction to the petitioner to approach the said Authority and get the said Show Cause Notice decided in accordance with law Date of Order 24-07-2017 W.P.No.31521/2017 M/s. Black Buck Wineyards Pvt., Ltd., Vs. The Commissioner of Excise and Another. 3/3 expeditiously, within the timeframe of one month from today. No costs.
