                 S.B. Civil Writ Petition No.5213/2017
Murli Singh Yadav Memorial Shikshan Sansthan, Through Its
President Kuldeep Yadav S/o Shri Manmohan Singh Yadav,, Aged
About 32 Years, Karni Coach, Udriramsar, Bikaner (Rajasthan).
                                                                   ----Petitioner
                                    Versus
Northern Regional Committee, National Council for Teacher
Education Through Its Regional Director,, 4th Floor, Jeevan Nidhi-
II, LIC Building, Ambedkar Circle, Bhawani Singh Marg, Jaipur,
                                                                 ----Respondent

_____________________________________________________ For Petitioner(s) : Mr. M.S. Raghav.

For Respondent(s) : Mr. Raj Kumar Suthar. _____________________________________________________ HON'BLE MR. JUSTICE ALOK SHARMA Order 24/04/2017 Admittedly, the petitioner-institute has been issued in show cause notice dated 10.03.2017 by the Northern Regional Committee (NCTE) and reply thereto has been filed by the petitioner on 03.04.2017.

Counsel for the petitioner submitted that yet despite the pendency of the proceedings under the show cause notice, the petitioner-institute has approached this Court invoking its extraordinary equitable jurisdiction in view of the fact that the NRC is taking a discriminatory view against the petitioner-institute on its application for grant of recognition for the STC course. It has been submitted that while various institutions who had applied for grant of recognition for Teachers Training Courses offline and never applied online either under the Regulation of 2009 or the (2 of 2) [CW-5213/2017] subsequent ones of 2014, have been granted recognition such as vide order dated 26.08.2016 to Shri B.L. Indoriya Memorial Teacher Training College, Rasoolpur, Kaymasar, Sikar, Rajasthan (only illustratively) the petitioner-institutes application for grant of recognition has not been proceeded with on the ground that it applied offline under the Regulations of 2014 in continuation of its pending online application filed earlier on 18.12.2012 under the Regulations of 2009.

Having heard the counsel for the petitioner, I would dispose of this petition directing the NRC to finally decide on its show cause notice dated 10.03.2017 to the petitioner-institute reckoning for its reply filed thereto on 03.04.2017 in a non- discriminatory manner. This be done within three days of the receipt of a certified copy of this order in view of the last date for recognition of teacher training courses being 02.05.2017 for the Academic Year 2016-2017 as directed by the Apex Court.

The petition stands disposed of accordingly.
