1.The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.14/2010 registered in Police Station Mainpur, District Gariyaband for offence under Sections 409, 420, 467, 468 and 471/34 of the IPC.
2. In an enquiry constituted by the Zila Panchayat, Raipur for financial irregularities in 9 projects of road construction in the year 2007-08 in the Mainpur block of district Gariyaband, it was found that an amount of Rs.2,08,18,000/- has been embezzled by 5 accused persons who have been charge sheeted in the present crime.
3. Admittedly, charge sheet was filed in the year 2012 but the applicant 2 could not be arrested as he was pursuing his prayer for anticipatory bail. He has surrendered before the trial Court on 21.1.2019. At the relevant time the applicant was working as Executive Engineer, RES at Mainpur, Gariyaband. He is aged about 67 years and has now retired from service.
4. Learned State Counsel would oppose the prayer for grant of bail to the applicant.
5. Considering that co-accused Sandhya Meshram and Awadh Kishore have already been released on regular bail by this Court in MCrC Nos.1399/2018 and 4351/2018 respectively, as also for the reason that the applicant is aged about 67 years and the offences are triable by the Judicial Magistrate 1st Class, this Court is inclined to release the applicant on bail.
6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
