ORDER
Information sought:
The Appellant filed an online RTI Application dated 13.06.2021 seeking information as under:
The CPIO vide online reply dated 29.06.2021, informed to the Appellant as under:
Being dissatisfied, the appellant filed a First Appeal dated 29.06.2021, which has not been adjudicated by the First Appellate Authority as per available records.
Grounds for Second Appeal:
The Appellant filed a Second Appeal u/s 19 of the Act on the ground of unsatisfactory reply furnished by the Respondent. Appellant requested the Commission to direct the CPIO to provide complete information sought for and take appropriate legal action against the Respondent.Page 2 of 5

The Appellant stated that he is not satisfied with the reply furnished by the Respondent with respect to point 3 of the RTI Application.
The Respondent submitted that during COVID pandemic formative assessment was not done so only summative marks were taken therefore the marks of formative assessment is not available. Further, a copy of an email reply substantiating the above stance has also been given to the Appellant during hearing.
A written submission has been received by the Commission from the Appellant vide letter dated 12.11.2022, wherein the Commission has been apprised as under:
A written communication has been sent to the Appellant by Shri. Gurdev Singh, Regional Director, National Institute of Open Schooling, Regional Center Chandigarh vide letter dated 19.11.2022 and the same has been Page 3 of 5 CIC/NIOPS/A/2021/638735 marked to the Commission wherein the Appellant has been apprised as under:
Decision:
Upon perusal of the facts on record as well as on the basis of the proceedings during the hearing, the Commission observes that the Respondent has furnished a point wise and categorical reply with respect to the instant RTI Application to the Appellant within the stipulated time frame. However, the Respondent raised dissatisfaction with the reply furnished with respect to point 3 of the RTI Application for which the Respondent has furnished an adequate explanation to the Appellant. In view of the above, the Commission finds no further scope of intervention in the instant matter. With the above observations, the instant Second Appeal is disposed of. Copy of the decision be provided free of cost to the parties.
The Appeal, hereby, stands disposed of.
