1. As common question of law and facts are involved in bunch of these writ petitions, they are heard analogously and are being disposed of by this common order.

Present petitions have been filed by the petitioners who are working as Assistant Professor in various government colleges of the State of Chhattisgarh and they have prayed for issuance of writ of mandamus directing the State Government to pay academic grade pay of Rs. 7000/-, Rs.8000/- and Rs. 9000/- respectively as per the order dated 30.03.2010 (Annexure P/2) and Chhattisgarh Educational Services (Collegiate Branch, Gazetted) Recruitment Rules, 2019 framed in this regard.

Learned counsel for the petitioners would submit that the petitioners are having requisite service length and have also fulfilled the criteria fixed in Annexure P/2 dated 30.03.2010 still their case for senior academic grade pay has not been considered. The criteria provided in the order 30.03.2010 is as tabulated below:-:-

4. Learned counsel for the petitioners would further submit that the Recruitment Rule, 2019 Schedule 4 also provides criteria for eligibility to get grade pay. The criteria laid down in the Rules also provides for orientation course as well as refresher course which should be as per the norms prescribed by the University Grants Commission. He would further submit that all the petitioners have completed the orientation course as well as refresher course which is at par with the norms prescribed by the UGC still the respondents have not considered the case of the petitioners for grant of academic grade pay. Therefore, he would submit that the respondents be kindly directed to consider the case of the petitioners for grant of grade pay as per the order dated 30.03.2010 and the Rules of 2019.

Learned Additional Advocate General for the State on instructions would submit that for grant of senior academic grade pay they have to examine qualification, length of service and the other records pertaining to the petitioners as per the order dated 30.03.2010 and the Rules of 2019 which may take some time, therefore, he would pray that the State may be given reasonable time to examine the case of each of the petitioners for redressing Neutral Citation 2024:CGHC:21366 Page 38 of 38 of their grievance.

6. I have heard learned counsel for the parties and perused the record.

A bare perusal of the order and the Rules of 2019, particularly Clause 9 of the order and Schedule 4 of the Rules of 2019 make it explicitly clear that any Assistant Professor who has completed requisite length of service and having fulfilled the criteria as per the UGC Guidelines, he/she is eligible for academic grade pay as per his/her length of service.

Considering the factual matrix of the case, let the State constitute a committee if it has not been constituted for examining the case of the petitioners for grant of grade pay which will ascertain the eligibility criteria of individual petitioner. The Secretary Higher Education Department is directed to constitute a committee within one month from the date of receipt of copy of this order and in turn the committee will do the exercise for grant of academic grade pay to the petitioners within 3 months from the date of constitution of the committee. If the petitioners are found eligible for grant of academic grade pay the same shall be paid to them from the dates they are eligible for the same.

9. With the aforesaid observations and directions, the bunch of these writ petitions (S) is disposed of.
