                 Transport) Ward Quota on the basis of marks secured in the NEET examination
                 by the petitioner within time stipulated.

                                                                     ORDER

Heard the learned counsel for the petitioner; the learned Standing Counsels for the respondents 1 and 3; and the learned Government Advocate for the fourth respondent.

2. The petitioner claims entitlement to priority under the Institute of Road Transport (IRT) Ward Category. However, it is stated that due to an inadvertent oversight, the petitioner failed to mention the same while submitting the application for admission to the fourth respondent College.

3. The learned Standing Counsel for the first respondent submits that the first round of counselling has been completed and that all 30 seats reserved under the priority quota, namely, the IRT Ward Category, under which the petitioner now seeks consideration, have already been filled. However, it is submitted that the petitioner may still have a chance during the second round of counselling under the BC Muslim category and in the general quota in self-financing colleges under the Government Quota.

On the other hand, the learned counsel for the petitioner submits that although the petitioner failed to claim priority under the IRT Ward Category at the time of submitting the application, a representation had been sent to the third respondent. However, the third respondent did not forward the petitioner's request to the second respondent, resulting in her request being rejected or overlooked.

5. It is further submitted that at the time of applying through the third respondent, the petitioner's father was still in service and retired only on 31.05.2025. It is also contended that a candidate with lesser marks, specifically, a ____________ Page 3 of 6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 28/08/2025 12:47:56 pm ) W.P.(MD)No.23158 of 2025 score of only 237, has been accommodated under the BC Muslim category within the IRT Ward priority quota.

6. Having considered the submissions of the learned counsel for the parties, I am inclined to direct the respondents 1 and 4 to consider the petitioner's candidature for admission under the BC Muslim category in the second round of counselling for self-financing colleges under the Government Quota.

7. The Writ Petition stands disposed of with the above direction. No costs.

Consequently, connected Miscellaneous Petition is closed.
