W.P. 2005 (W) of 2015
Lakshmi Kanta Chakraborty
Versus
State of West Bengal & 0rs.
Mr. Subhajit Panja,
...for the petitioner.
Mr. Arijit Dey,
...for the respondents.
The affidavit of service filed in court today is kept on record.
The writ petitioner in this writ petition seeks interest on delayed payment of gratuity amount.
The writ petitioner had retired from his service on February 28, 2013. The pension payment order was issued in favour of the petitioner on February 5, 2014 and the payment in respect thereof was received by the writ petitioner on April 30, 2014.
I have heard the learned advocates appearing for the parties and considered the materials available on record. I have also considered the relevant judgments and orders placed before me by the learned advocates for the parties.
Having regard to the delay in payment of gratuity amount to the writ petitioner and keeping in view the judgments and orders referred to by the learned advocates appearing for the parties, I direct the concerned respondent to pay interest at the rate of eight (8) per centum per annum for the delayed period of payment of gratuity, that is, on and from March 1, 2013 till the date of actual payment of gratuity amount, within a period of eight (8) weeks from the date of communication of an authenticated copy of this order to him.
With the aforesaid direction, the writ petition is disposed of without, however, any order as to costs.
Photostat certified copy of this order, if applied for, will be made available to the applicant within a week from the date of putting in the requisites.
