The Original Application having been heard on 9 th January 2026,
the Tribunal on 4th February 2026 delivered the following :
ORDER
HON'BLE Mrs.V.RAMA MATHEW, ADMINISTRATIVE MEMBER The 1st applicant in this case is the Kendriya Vidyalaya Non Teaching Staff Association, an association of Non Teaching Staff recognized by the respondent, Kendriya Vidyalaya Sangathan (KVS). In this O.A the association represents the erstwhile Group 'D' staff and Lab Attendants of the KVS and also other categories of the Group 'D' staff like Daftry, Ayas, Lift Operators etc. The applicants 2 to 5 are aggrieved persons who are also members of the 1st applicant association.
2. It is submitted that the erstwhile Group 'D' categories which were designated as Group 'D' staff, Lab Attendants, Daftry, Lift Operators etc., were having separate Recruitment Rules and the strength of each cadre was also being maintained separately. The Recruitment Rules relating to the post of Group 'D' staff and Lab Attendants as it existed were produced A S Peethambaran 2026.02.04 13:08:01+05'30' -16- as Annexure A-1 and Annexure A-2. As per the applicable Recruitment Rules, the vacancies in the cadre of Lab Attendants is filled 100% by promotion, failing which by direct recruitment. The promotion is ordered from among the Group 'D' staff of the regional cadre, having the prescribed educational qualification meant for direct recruitment and two years' regular service. The educational qualification meant for direct recruitment was middle pass with General Science, whereas for the post of Group 'D' the educational qualification was only middle pass. In the process certain employees who are represented in this O.A were promoted as Lab Attendants also and they were discharging their duties in the various Laboratories attached to different schools. Pursuant to the recommendations of the 6th Central Pay Commission different Group 'D' staff were upgraded to Group 'C' cadre with a Pay Band of Rs.5200- 20200 (PB1) with Grade Pay of Rs.1800/-. As a result, the KVS issued an order dated 18.01.2010, produced as Annexure A-3 wherein it was stated that based on the recommendations of the Finance Committee Meeting which was held on 25.11.2009 it has been decided that hereafter all Group 'D' staff in KVS would be known as Sub Staff and all Group 'D' cadre post such as Lab Attendants, Daftry, Aya, Liftmen etc., stand merged. Further, they would continue to perform their existing duties A S Peethambaran 2026.02.04 13:08:01+05'30' -17- along with the skilled work of Group 'C' that may be assigned to them by their Cadre Controlling Officer. In paragraph 3(iii) of Annexure A-3 it has been stated that "the existing seniority of the Group 'D' cadre will remain unchanged and the incumbents would be placed at their respective places with new designation." A reading of Annexure A-3 order would show that each of those who were already in position as on the date of Annexure A-3 order would continue to discharge 'existing duties', though they can be called upon to discharge the additional duties mentioned in paragraph (ii) of Annexure A-3. It is submitted that the identity of the Lab Attendants is maintained and the posts are continued to be maintained separately. The Recruitment Rules relating to the posts of Lab Attendants have not so far been repealed nor amended by any process known to law. Similarly, apart from Annexure A-3, no Recruitment Rules have been framed or published in accordance with law for appointment to the post in Group 'D' categories.

It is submitted that even for the purpose of transfers from one place to another the identity of posts is still being maintained as is evident from the latest transfer guidelines issued in the year 2015, produced as Annexure A-4. Hence, the post of Lab Attendants continue to be a A S Peethambaran 2026.02.04 13:08:01+05'30' -18- separate cadre and that the posts of Lab Attendant, Liftmen etc., have an element of skill involved and are in fact in the nature of semiskilled job. In view of the inaction on the part of various principals as also different administrative heads of various regions in filling up the existing vacancies of the post of Lab Attendants and also the utilization of the existing Lab Attendants to discharge the function of other Group 'D' posts, including the posts from which they were promoted, the 1 st applicant Association took up the issue before the competent authorities by filing representations in this regard and one such representation is produced as Annexure A-5. It is submitted that as a matter of fact after 01.01.2006, the respondents have stopped filling the vacancies of Lab Attendants and wherever they have been so filled, the fitment benefits initially given was nullified. Similarly, after 29.08.2008 also ie., the date on which the recommendations of the 6th CPC was approved and published, the benefit of promotions was not being given.

It is pointed out that the DoP&T issued an Office Memorandum dated 16.10.2015 stating inter-alia that those who got the benefit of promotion between 01.01.2006 and 29.08.2008 to the scale of pay which now stand merged should be given the benefit of Rule 13 of CCS A S Peethambaran 2026.02.04 13:08:01+05'30' -19- (CCA) Rules, 2008 by granting the benefit of an increment @ 3% of the basic pay. In Annexure A-6, there is a reference to an O.M dated 07.01.2013 also issued by the Ministry of Finance directing grant of benefit of one increment @ 3% of the basic pay to those who are promoted after 29.08.2008 to posts that carry the same scale of pay as of the feeder post, which means that those who are promoted as Lab Attendants before or after 29.08.2008 should also get the benefit of fixation of pay applying Rule 13 of CCS (RP) Rules, 2008. Notwithstanding the said position, the vacancies in the cadre of Lab Attendants is being operated by engaging outsiders/contract employees and even by posting persons who are far juniors in the cadre without following any specific criteria. It is further pointed out that the applicants at present have no avenue of promotion except for a 10% quota to the cadre of LD Clerk that too purely based on all India seniority which is illusory. Hence this O.A.

It is argued that in terms of Annexure A-3, there is no merger of posts nor is there a merger of cadres and only the different groups of staff would stand merged for the purpose of grant of only PB1 + Grade Pay Rs.1800/-. As mentioned earlier, each one of them would A S Peethambaran 2026.02.04 13:08:01+05'30' -20- continue to discharge their existing duties though they could be called upon to discharge additional duties specifically mentioned in that order. It is argued that this indicate that the identity of the cadre is separately maintained and therefore, the vacancies in the various cadres are to be filled in accordance with law and those who are already working as Lab Attendants should be allowed to continue to discharge the duties attached to the post of Lab Attendants. This would consequently indicate that the seniority list of each cadre is to be maintained independently and the educational qualification prescribed for Lab Attendants was distinct and separate as per the terms of Annexure A-1 and Annexure A-2.
6. It is pertinent to examine the reliefs sought by the applicants in this O.A which are as follows -
1. Direct the respondents to prepare and publish separate seniority list for each of the erstwhile Group 'D' cadres as envisaged in Annexure A-3.
2. Declare that the non-feasance on the part of the respondents to fill up the existing vacancies of Lab Attendants, in accordance with the existing Recruitment Rules, is arbitrary, discriminatory, contrary to law and hence, violative of the constitutional guarantees enshrined in Articles 14 and 16.

3. Direct the respondents to fill the existing vacancies of Lab Attendants which were in existence and which arose after 01.01.2006 in accordance with law and to grant the benefit of Annexure A-6 and Annexure A-7 orders of the Ministry of Finance, in accordance with law.
4. Declare that the Lab Attendants and Group 'D' staff constitute separate classes and that there is no justification in linking the posts or the incumbents of the post of Lab Attendants along with other Group 'D' employees. The conduct of the respondents in treating, the Lab Attendants as part of the other Group 'D' cadres of the Kendriya Vidyalaya Sangathan is arbitrary and discriminatory and hence, unconstitutional.
5. Issue an order prohibiting the respondents from engaging outsiders/contract employees in discharging the functions of Lab Attendants in preference to persons like the applicants and direct the respondents accordingly.
7. The fundamental basis for the relief sought is the assertion that the Group 'D' cadres are not merged as per the terms of Annexure A-3 dated 18.01.2010. If we go through Annexure A-3 it indicates the reasons behind upgrading the posts to Group 'C' cadres and that it is clearly stated that based on the recommendations of the Finance Committee in its meeting held on 24th and 25th November, 2009 as approved by the Board of Governors, KVS in its 85th Meeting held on 14.12.2009 the following is the decisions -

(i) Hereafter all Group 'D' staff in KVS will be known as 'Sub-Staff'. All Group 'D' cadre posts viz., (1) Lab Attendants (2) Daftry (3) Aya (Hostel), (4) Liftmen etc., henceforth stand merged.
(ii) They would continue to perform their existing duties alongwith the skilled work of Group 'C' that may be assigned to them by their Cadre Controlling Officers which include the following -
(a) To attend to telephone calls/operating of Fax Machine/Franking Machine/Xerox Machine/Handling of Fire Fighting Equipments etc.
(b) Maintaining of files/records/retrieval of documents pertaining to TA/LTC, Medical/Leave Application/Monthly Return Forms/Pay Bill Form etc.
(c) Handling of Banking Operations eg., Deposit/Withdrawal of cash from Bank.
(d) Minor local purchases.
(e) Operating of water pump/use of electrical
equipment/water cooler.
(f) Dairy/Despatch of letters-Regd./Speed
Post/Ordinary/VPP/Insured/ Purchase of Postal Stamps etc.
(g) Booking of Rail Ticket/Maintaining of telephone/mobile number of staff etc.
(iii) The existing seniority of the Group 'D' cadre will remain unchanged and the incumbents will be placed at their respective places with new designation.
(iv) The existing staffing norms as applicable in KVs/ROs/ZIETs/HQ will continue.

(v) The existing provision of outsourcing of 3 services ie., watch and ward, cleaning of school buildings, toilets, class rooms etc., and maintenance of gardens, lawns and compound in KVS will continue without any linkage to the number of sanctioned posts in the KVs/ZIETs/ROs/HQ. There will be no change in the funding pattern being followed.
8. The first decision listed talks about the merger of Group 'D' cadre posts ie., Lab Attendants, Daftry, Aya (Hostel), Liftmen. Therefore, the contention of the applicants that the cadres were not merged stands disapproved. The next decision regarding the performance of duties is merely work allocation and not the legal position of Sub Staff. The main arguement of the applicants is that Annexure A-1 and Annexure A-2 continue to remain and individual who qualify as Lab Attendants as per the terms of Annexure A-2 can discharge functions of Lab Attendants. Reference is drawn to the Office Memorandum dated 27.06.2025 which referred to the amended Recruitment Rules for KVS Teaching and Non- Teaching posts vide Office Memorandum dated 20.03.2025 wherein it has been stated that the Recruitment Rules for the post of Sub-Staff effective from 12.02.2014 has no change. Recruitment Rules for the post of Sub- Staff has been produced during the course of the argument. So clearly from that date common Recruitment Rules for the merged cadre also existed. Hence, the reliefs sought, therefore, will not stand. However, the A S Peethambaran 2026.02.04 13:08:01+05'30' -24- KVS may examine the eligibility of the applicants for pay fixation in terms of Rule 13 of CCS (RP) Rules, 2008 in terms of the Office Memorandum dated 16.10.2015 for those Lab Attendants who were promoted between 01.01.2006 and 29.08.2008. Once the cadre stood merged with effect from the date of Annexure A-3 letter, there is no question of operating the Recruitment Rules which applied to the pre- existing cadres so promotions could not happen under the pre-existing Recruitment Rules as pre-existing cadres in the Group 'D' no longer existed from the date of merger. Therefore, promotions could happen only from the date of notification of the Recruitment Rules for the post of Sub-Staff ie., 12.02.2014. O.A is accordingly disposed of. No order as to costs.
