Section 49 in The Calcutta Municipal Corporation Act, 1980
49. Doubts as to powers or functions of municipal authorities. -
If any doubt arises as to whether any particular power or function appertains to any municipal authority or the Municipal Commissioner, the Mayor shall refer the matter to the State Government and the decision thereon of the State Government shall be final.
