The present application has been filed by the applicants M/S Golden Triangle Services and Ambrish Kumar Tyagi, with the following prayers :-
"It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to :
A. quash the impugned charge-sheet dated 28.6.2022 (contained in Annexure-1 to this application), under Section 406, 420 & 120-B I.P.C., submitted by Police Authorities in Case Crime No. 463 of 2021, under Section 406 and 420 I.P.C., P.S. Kotwali Nagar, District Muzaffar Nagar.
B. quash the entire proceedings of Criminal Case No. 12699 of 2022 (State Versus Golden Triangle), under Section 420, 406, 120-B I.P.C., pending in the Court of Chief Judicial Magistrate, Muzaffar Nagar.
C. in addition to or in substitution above, to grant such other and further relief in favour of the petitioners, which this Hon'ble Court may deem just and proper in the interest of justice.
D. award the cost."
At the very outset, learned counsel for the applicants states that the present matter be dismissed as withdrawn as he intends to file a better petition disclosing and enclosing the subsequent developments also.
Prayer is allowed.
The present application is dismissed as withdrawn.
