Mr. Biswabrata Basu Mallick Ms. Tapasi Sinha .....for the petitioner Mr. Parijat Som......for the State The petitioner applied for a contract carriage permit on July 02, 2013 in respect of the route Rajabhatkhowa Tea Garden to Salsalabari Hat before the Regional Transport Authority, Jalpaiguri (hereafter the R.T.A). It is the grievance of the petitioner that such application has not been favoured with any consideration by the R.T.A. Having heard learned advocates for the parties and considering the nature of grievance expressed by the petitioner, I find no reason to keep the writ petition pending. The same stands disposed of with a direction upon the R.T.A. to consider and dispose of the petitioner's application for permit in accordance with law, as early as possible but not later than four months from date of receipt of a copy of this order.

Needless to observe, if the petitioner's application is rejected, the order must have the support of reasons. On the contrary, if the prayer of the petitioner deserves acceptance, necessary follow up steps shall be taken without any further delay.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible.
