Shri Sanjay Kumar Verma, learned counsel for the petitioner.
Office has raised an objection regarding maintainability of the petition and also
for orders on default as petitioner has wrongly arrayed the Presiding Officer of the
Labour Court as respondent.
In view of para 31 of the decision rendered by the Supreme Court in the case of Jogendrasinghji Vijaysinghji Vs. State of Gujarat and Others (2015) 9 SCC, the objection is over ruled.
Heard on the question of admission as well as for grant of interim relief. Issue notice to the respondents on payment of process fee within seven days by all modes, returnable within three weeks.
Subject to compliance of Section 17-B of the Industrial Disputes Act, 1947, the execution and operation of the impugned show-cause notice dated 23.08.2022 (Annexure P/2) shall remain stayed till next date of hearing.
Learned counsel for the petitioner is directed to file an affidavit before next date of hearing that they have complied with the provisions of Section 17-B of the Industrial Disputes Act, 1947.
