Section 398 in West Bengal Municipal Act, 1993

398. Time for complying with requisition or order, and power of Board of Councilors to enforce requisition or order in default.

(1)When, under this Act or the rules or the regulations made thereunder, any requisition or order is made by a written notice issued to any person or persons by any municipal authority or any officer of the Municipality, such authority or officer shall specify in such notice a period within which -
(a)such requisition or order shall be complied with, and
(b)any written objection thereto shall be received by such authority or officer.
(2)If any such requisition or order or any part thereof is not complied with within the period specified under sub-section (1), the Board of Councilors may, subject to such regulations as may be made by the Board of Councilors in this behalf, take such measures or cause such work to be executed or such thing to be done as may, in its opinion, be necessary for causing due compliance with such requisition or order; and, except as otherwise expressly provided in this Act or the rules or the regulations made thereunder. the expenses, if any, incurred by such authority or officer in causing such compliance with such requisition or order, shall be paid by the person or persons to whom such notice is issued.
(3)The Board of Councilors may take any measure, execute any work or cause anything to be done under this section, notwithstanding any prosecution or punishment or liability to punishment of any person under this Act or the rules or the regulations made thereunder for his failure to comply with such requisition or order.
