  03.   1.      This matter is taken up through hybrid arrangement
        (virtual/physical Mode).

2. The Petitioners having been implicated in C.T. Case No.746 of 2019 arising out of Sukinda P.S. Case No.151 of 2019 registered for alleged commission of offence under sections 407/408/34 IPC pending in the court of learned J.M.F.C., Jajpur Road have filed this application for grant of anticipatory bail.

3. Heard learned counsel for the Petitioners and learned counsel for the State as well as the learned counsel for the Informant.

4. Considering the submissions and viewing the materials on record as also other surrounding circumstances; while being Page 1 of 2 // 2 // not inclined to grant anticipatory bail to the Petitioners; it is observed that in the event the Petitioners surrender before the court in seisin of the case in the aforesaid case within a period of fifteen days hence and move for their release on bail, the same shall be considered on its own merit; further taking into account the factum of release of co-accused person/s on bail, if similarly situated on the ground of parity, as per law without being prejudiced by this order and disposed of early in accordance with law so as to enable the Petitioners to approach the next higher forum early in case necessity so arises.

The case record be made available at the cost of the Petitioners.

5. Interim order passed on 01.07.2019 does no more survive.

6. The ABLAPL stands disposed of.

Issue urgent certified copy as per rules.
