Mr. D.L. Chidananda, AOR UPON hearing the counsel, the Court made the following O R D E R [ 1 ] I.A. NOs. 20650 OF 2023, WITH I.A. NO. 75033 OF 2023 AND I.A. NO. 199355 OF 2024
1. The matter is listed today since on the last date of 26 W.P. (Civil) No. 202/1995 hearing it was found that though the State Government has granted sanction in respect of the prosecution of all the officers except one, this Court wanted to find out as to why special treatment was being given to the said officer. This was also in the background that on an earlier occasion, this Court has found that the said officer was given a special posting despite the prima facie findings against him by the CEC, which were affirmed by this Court.
2. Today, an affidavit has been filed by the State of Uttarakhand wherein it is stated that the State Government has granted sanction for prosecution against the said officer under Section 218 of BNSS/197 of the Cr.P.C. It is submitted that insofar as the sanction under Section 19 of the Prevention of Corruption Act, 1988 (for short ‘the PC Act”), the State Government has also forwarded the papers for sanction of the Union of India.
3. Insofar as the delay in departmental proceedings is concerned, the learned Solicitor General submitted that earlier the department proceedings were initiated against the said officer for a minor penalty. However, upon the charge sheet being filed by the CBI, it has been noticed that he is liable to be charged for major penalty and therefore, now the charge sheet is issued to him for 27 W.P. (Civil) No. 202/1995 major penalty.
4. We accept the submissions of the State Government.

However, we direct the State Government to conclude the departmental proceedings against the said officer as expeditiously as possible, and in any case within a period of three months from today.

5. We also direct the Union of India to consider the proposal submitted by the Government of Uttarakhand for grant of sanction under Section 19 of the PC Act. [ 3 ] I. A. NOS. 153500 & 153501 OF 2024 WITH I. A. NO. 153502 OF 2024 AND I.A. NOS. 206123 & 214893 OF 2025:

1. From the perusal of the material placed before us, it appears to us that the State of Uttarakhand is indulging in not only dilly dallying tactics, but is also attempting to take the Court for a ride.
2. It was earlier brought to the notice of this Court that in spite of the NGT issuing a direction to the State Government vide order dated 12.07.2022 to consider whether the area of Saranda/Sasangada Forest needs to be declared as a sanctuary or not, the State of Jharkhand had not taken any steps.
3. The applicant herein, therefore, was required to file an I.A. No.153500/2024. This Court vide order dated 20.11.2024 had recorded that it was not in dispute that 28 W.P. (Civil) No. 202/1995 the area consists of pristine forest and it is a repository of some of the finest Sal trees in the country. The Court also recorded that it was an undisputed position that the said area was having rich wildlife and as such requires protection and preservation. The Court therefore, prima facie observed that there was no reason as to why the State did not take steps to implement the directions issued by the NGT on 12.07.2022. We, therefore, directed the State to file an affidavit explaining the aforesaid position within a period of two weeks from the date of said order, i.e. 20.11.2024.
4. In compliance to the aforesaid, an affidavit was filed before this Court on 02.12.2024. In the said affidavit it was stated that the Principal Chief Conservator of Forest Wildlife (PCCF-WL)-cum-Chief Wildlife Warden (CWLW), Jharkhand vide Memo No. 1263 dated 29.11.2024 had moved a proposal to the Government of Jharkhand for declaration of “Saranda Wildlife Sanctuary” and “Sasangdaburu Conservation Reserve”. In the said affidavit, the details of the area to be included in the Saranda wildlife sanctuary was shown as 575.1941 sq. km. and the area to be included in Sasangdaburu Conservation Reserve was shown as 136.03806 sq. km.

5. Vide our order dated 20.02.2025, we expected that the State Government would take action expeditiously.
6. Thereafter, when the matter was listed before us on 16.04.2025, another affidavit was filed by the State Government stating therein that the matter was examined by the Department of Forest, Environment and Climate Change, Government of Jharkhand and was sent back on 23.03.2025 to the PCCF (HoFF) for examination.
7. This Court vide order dated 16.04.2025 specifically found that it was almost after a period of four months from the date on which the proposal was received by the State Government from the PCCF-WL cum CWLW that the proposal was again sent back to the Principal Chief Conservator of Forest for his comments. The Court expressed that there was no propriety of keeping the matters pending for almost four months, particularly when an impression was given to this Court in the affidavit dated 02.12.2024 that the matter is being processed expeditiously by the State Government. We had, therefore, directed the Secretary, Department of Forest, Environment and Climate Change, Government of Jharkhand to remain present before this Court on 29.04.2025.
8. On 29.04.2025, Mr. Abu Bakr Siddiqui, Secretary, Department of Forest, Environment and Climate Change, Government of Jharkhand was present in the Court. An 30 W.P. (Civil) No. 202/1995 affidavit was also filed on behalf of the State Government. In the said affidavit, it was specifically stated that the State Government had proposed to notify an area of 57,519.41 Hectares as against the original proposal of 31,468.25 Hectares as the wildlife sanctuary.

The affidavit further stated that an area admeasuring 136.03806 sq. km. Or 13603.806 Hectares has been proposed to be notified as conservation reserve. It was further stated that the proposal was sent for comments to the wildlife Institute of India (WII), Dehradun. It was also stated that as soon as the comments are received from the WII, the proposal would be placed before the State Cabinet and after the approval of the State Cabinet, the final notification would be issued.

9. On the basis of the said affidavit dated 29.04.2025, we had requested the WII to examine the proposal and forward the same along with its comments to the State of Jharkhand within a period of one month from the said date. We had also directed the Secretary, Department of Forest, Environment and Climate Change, Jharkhand, to communicate the order to the WII. We had further directed the State of Jharkhand to complete all the formalities upon receipt of the comments from WII within a period of two months thereafter.

10. A supplementary affidavit filed by the State dated 31 W.P. (Civil) No. 202/1995 22.07.2025 states that the WII has given its positive recommendations Vide report dated 30.05.2025.

11. In that view of the matter, the State was expected to complete the formality, i.e. the approval of the State Wildlife Board and the Cabinet within a period of two months thereafter, i.e. on 30.07.2025. However, now we are informed that the Chief Secretary of the State of Jharkhand on 13.05.2025 constituted a Committee under the Chairmanship of Chief Conservator of Forest for conducting ‘a comprehensive review of the boundary/area determination of the proposed Sanctuary in consideration of the interest of the State and in compliance with the orders of the Hon’ble Supreme Court’.

12. The primary reason given in the said letter was that the Geological Survey of India has identified certain Prospecting Areas for future mining which fall within the proposed area of Saranda Wildlife Sanctuary.

13. It is, thus, clear to us that the conduct of the State, to say the least, has been totally unfair. When on various occasions, i.e. on 20.02.2025, 16.04.2025 & 29.04.2025, a clear indication was 32 W.P. (Civil) No. 202/1995 given to the Court that the State has proposed to notify an area of 57,519.41 Hectares as wildlife sanctuary and conversation reserve, now the State is turning on its stand by appointing a Committee for the same purpose vide order dated 13.05.2025. If the State was alive to the concerns expressed in the Minutes dated 13.05.2025, then nothing prohibited it from placing the same before this Court in the affidavit dated 02.12.2024, or the affidavit dated 29.04.2025.

14. As a matter of fact, when the Secretary was present in the Court, in the affidavit dated 29.04.2024, a clear indication was given to the Court that upon approval by the WII, all the necessary formalities, i.e. obtaining the approval of the State Wildlife Board and the Cabinet would be completed. We had, therefore, given two months period to comply with the formalities.

15. We are of the considered view that the State Government of Jharkhand is in clear Contempt of the order passed by this Court on 29.04.2025.

16. We, therefore, direct the Chief Secretary of the State of Jharkhand to remain present in this Court 33 W.P. (Civil) No. 202/1995 on 08.10.2025 at 10.30 am and show cause as to why an action should not be taken against him for committing Contempt of the order of this Court dated 29.04.2025.

17. We further clarify that if the State fails to comply with its statements made in the affidavit dated 29.04.2025, the Court would be required to issue a Mandamus commanding the State to comply with the statement made before this Court.

18. The application for intervention is rejected while reserving the rights of the applicant to take recourse to such remedies as are available in law.

19. If the order dated 29.04.2025 is complied with in the meantime, the personal presence of the Chief Secretary, State of Uttarakhand shall stand exempted.

20. List on 08.10.2025.

[ 4] I.A. NOS. 122148 & 122149 OF 2025 [5] I.A. NO. 132125 OF 2025 WITH I. A. NO. 132266 OF 2025 IN WRIT PETITION (C) NO. 171 OF 1996:

1. These applications pertain to the permission for grant of felling of Khair trees.
2. Taking into consideration the recurring issues, we had directed the State Government to 34 W.P. (Civil) No. 202/1995 come out with a policy so as to avoid the opening of flood gates of litigation before this Court.
3. The State has now filed an affidavit.
4. It can be seen from the affidavit that the State has appointed a Committee. After such a formation of Committee, we expect that the problems of the agriculturists will be addressed.

In case, any of the applicants are aggrieved with the orders passed by the said Committee, the person aggrieved would be at liberty to approach the High Court of Jammu & Kashmir.

5. The applications stand disposed of in the above terms.

[6] IA No. 2202 of 2008

1. The IA Nos. 2915, 2916 and 2917 of 2010 in IA Nos. 2201-2203 of 2008 are taken on Board.

2. These applications have been filed by the Panchmarhi Cantonment Board, Madhya Pradesh, seeking the following direction:

Allow the Interlocutory application directing the Respondents to issue the notification under Section 26A of the Wildlife (Protection) Act specifying the boundaries of the Pachamarhi Sanctuary while excluding the area of the applicant Pachamarhi Cantonment Board as per orders passed by the Collector Hoshangabad under section 24.

3. It is stated in the application that there are 842 houses in the notified civil area of the Cantonment. It is submitted that the Cantonment Board is unable to discharge its statutory obligations and developmental activities have come to a standstill because the area is still being treated as an area within the Sanctuary, even though the same stands excluded in view of orders passed by the Collector of Hoshangabad under Section 24 of the Wildlife (Protection) Act.

4. This Court had initially passed an order on 14.08.2017 wherein it took note of the fact that the Army Training Corps College and Centre is utilizing an area of 395 hectares of land belonging to the applicant. The Court specifically observed that the need of the Army must certainly be taken into consideration while at the same time the need for protecting wildlife in Pachmarhi, particularly in the sanctuary area must also be taken into consideration.

5. This Court found that the better way for resolution was to have a dialogue with all the stakeholders as well as the representatives of the 36 W.P. (Civil) No. 202/1995 State of Madhya Pradesh and the Central Government. The Court, therefore, directed the Secretary, Ministry of Defence to either personally look into the issue or nominate a senior officer of the Ministry (not below the rank of Joint Secretary) to look into the issue and have a dialogue with all the stakeholders.

6. Insofar as the construction activities are concerned, this Court found that in the event it is decided to exclude 1001.192 hectares of land or any part thereof from the sanctuary, there could be certain restrictions on the construction. The Court also observed that the possibility of making the rules and regulations of the Cantonment Board applicable could also be considered.

7. Vide another order dated 09.05.2018, this Court observed that an area admeasuring 607.582 hectares was a non-forest Cantonment land and 395 hectares was a deemed forest land being part of Cantonment land belonging to the Army. The Court recorded that in the meeting, it was agreed that 234 hectares out of 395 hectares should be kept as a deemed forest under the control of the Army authorities. However, the Court 37 W.P. (Civil) No. 202/1995 observed that since the entire 395 hectares of land was a deemed forest, the entire 395 hectares be maintained as a deemed forest under the control of the Army authorities. The Court, therefore, clarified that the area of 395 hectares will continue to remain as deemed forest and can be utilized by the Army authorities for jungle warfare, but no trees will be damaged or cut in that area. The Court had then adjourned the matter.

8. In pursuance to the orders passed by this Court dated 14.08.2017 and 09.05.2018, a meeting was held under the Chairmanship of the Joint Secretary (Works), Ministry of Defence. The other members present in the meeting are as follows:

9. It would be appropriate to refer to the Minutes of Meetings of the Meeting held on 10.01.2018, which state as follows:

“2. The first issue that was discussed during the meeting was regarding the IA filed by Panchmarhi Cantonment Board.
(i) It was brought up during the discussion that Panchmarhi Cantonment has a population of 12000 (approx.) as per Census 2011, whereas SADA has a population of 2500 (approx.).
(ii) Moreover the plot sizes of Pachmarhi Cantonment Civil Area range from 90 sq. ft.

to 5000 sq. ft. whereas in SADA it ranges from 10000 sq. ft. to 25000 sq. ft.

(iii) Further the number of plots in Cantonment Area is 835 since 1935 and only one additional plot was given in 1970.

(iv) It was agreed that building by laws of SADA which permit only ground plus one floor will not be suitable in Cantt. Where sizes of plots are small and density of populations is more. Hence, ground plus two floors with FSI of 1.0 was recommended for Pachmarhi Cantonment.

(v) It was finally agreed that total area of 39 W.P. (Civil) No. 202/1995 Panchmarhi Cantonment measuring around 1001.192 hectares be excluded from Panchmarhi Sanctuary and building bye laws of Cantonment Board be made applicable with a condition that maximum permissible floors be limited to ground plus two and FSI be restricted to 1.0.

3. Regarding another issue i.e., the IA filed by LMAs for 395 hectares of A-1 and B-4 defence land, only preliminary discussion was held and it was decided that the issue will be taken up in subsequent meeting, the date of which will be finalized soon.”

10. It could thus be seen that in the meeting, it was held that Panchmarhi Cantonment has a population of 12000 (approx.) as per the Census of 2011, whereas Special Area Development Area (for short “SADA”) has a population of 2500 (approx.). It was further found that plot sizes of Pachmarhi Cantonment Civil Area range from 90 sq. ft. to 5000 sq. ft. whereas in SADA it ranges from 10000 sq. ft. to 25000 sq. ft. It was further noticed that in the Cantonment area, the number of plots was 835 since 1935 and after that one additional plot was given in 1970. It was also 40 W.P. (Civil) No. 202/1995 noticed that the applicability of the SADA Rules would not be feasible in the Cantonment area, as the plots size were small and, therefore, it was decided that the rules applicable to the Cantonment area, which permit construction upto ground + 3 floors, should be made applicable.

11. Subsequent to the aforesaid meeting, an another meeting was held on 28.03.2018 in which the following decision was taken:

“Keeping in view the directions of the Hon’ble Supreme Court and the views of representatives of the State Government, Local Military Authority, representative of Yuva Tarang, Cantonment Board Pachmarhi, officials from Directorate General of Defence Estates (DGDE) and Army Headquarters, the following decisions were taken unanimously under the Chairmanship of Joint Secretary (Works) in the Ministry of Defence.
(a) The entire area of Pachmarhi Cantonment measuring 1001.192 Hectares may be excluded from the notified area of the Sanctuary.
(b) Keeping in view the need for protecting wildlife in Pachmarhi, it was decided that the forest land measuring 20.78 Hectares classified has A-1 Defence Land (Survey No.

12 & 14) and 213,375 Hectares classified as 41 W.P. (Civil) No. 202/1995 B-4 Defence Land (Survey No. 13, 15, 16, 18,20 & 22) according to General Land Register (GLR) maintained by Defence Estates Officer (DEO), Jabalpur shall remain as deemed forest land under the ownership of Ministry of Defence, Government of India and that their status as deemed forest land will be maintained by the custodian of the land.

(c) Keeping in view the feedback of all stake holders, it was decided in partial modification of the decision taken on 10.01.2018, that the applicable laws and bye- laws of the Panchmarhi Cantonment Board will apply with respect to the Construction activities within the Pachmarhi Cantonment Area.

12. The earlier Amicus Curiae in his note dated 12.04.2018 had opposed the decision taken in the Minutes of Meeting. He had suggested that the construction be restricted to a maximum of ground + 2 floors with the maximum FSI of 1.0 subject to the maximum height limit of 10.05 meters. He had also suggested that no new area will be leased by the Cantonment Board to any non-government entities.

13. We find that when the Committee consisting of all 42 W.P. (Civil) No. 202/1995 stakeholders, including the representative of the Defence Ministry, the State Government, the CEO of the Panchmarhi Cantonment Board as well as other stakeholders arrived at a unanimous decision, there should be no reason for this Court to not accept the same.

14. Insofar as the objection of the earlier learned Amicus Curiae with regard to the restriction of construction to ground + 2 floors is concerned, we find that if the relevant rules of the Pachmarhi Cantonment Board permit the construction upto ground + 3 floors, there should be no reason to disallow the same.

15. Insofar as the concern of the earlier learned Amicus Curiae regarding no further plots be allotted to the private individuals is concerned, the record would reveal that since 1935, the number of plots allotted has remained static at 835 and only in the year 1970 was one additional plot allotted.

16. We are, therefore, inclined to affirm the Minutes of Meeting of the Joint Committee.

17. The interim order granted by this Court shall stand vacated. The applicant (Panchmarhi Cantonment 43 W.P. (Civil) No. 202/1995 Board) would be entitled to proceed further in accordance with the decision taken in the meeting dated 28.03.2018.

18. However, it is directed that hereinafter the Panchmarhi Cantonment Board shall not allot any plots to any private individuals.

19. It is further directed that the Panchmarhi Cantonment Board shall ensure that whatever construction it permits will be strictly in accordance with the rules applicable to the area falling under Cantonment Board. Any construction made in violation of such rules shall be dealt with an iron hand.

20. In view of the above, these applications are disposed of.

1. The present Contempt Petition is filed alleging contempt of the orders of this Court wherein the State had directed State Level Committee to monitor the functioning of wood based industries.

Amit Hemawat, Deputy Conservator of Forest stating therein that the order passed by this Court has already been complied with. A notification dated 20.08.2025 47 W.P. (Civil) No. 202/1995 has also been placed on record by which the Committee as required under the Wood-based Industries (Establishment and Regulation) Guidelines, 2016, has been duly constituted.
3. In that view of the matter, we do not propose to proceed further with the Contempt Petition and the same stands disposed of.

1. These applications have been filed with a grievance that one embankment has been constructed on the foot of river Yamuna near Kalesar Wild Life Sanctuary, as a result of which the flow of Yamuna river has been diverted from Haryana to Uttar Pradesh. It was the submission of the applicant that this has been done in order to facilitate rampant mining activity.
2. We had requested the CEC to examine the matter and submit its report.
3. In the report of the CEC dated 26.05.2025, the CEC has found the said embankment and had also made various recommendations.
4. In compliance, an affidavit has been filed on behalf of the State of Haryana. It is reported that the said embankment has already been removed 48 W.P. (Civil) No. 202/1995 and various steps have been taken in order to implement the recommendations made by the CEC.
5. The CEC has verified that the embankment has been removed.
6. We, therefore, close the matter. However, we direct the State Government to strictly implement the recommendations of the CEC in its report dated 26.05.2025.
7. We also request the CEC to monitor the implementation of the recommendations made, from time to time.
