ORDER
% 30.03.2026
1. As per the counter affidavit filed by Respondent No. 1, the Petitioner's request for processing her claim for switch from New Pension Scheme1 to Old Pension Scheme2 could not be processed on account of non- availability of requisite documents. In this regard, reliance is placed on Paragraph No. 8 of the counter affidavit, which reads as under:
"8. That however, the school vide its mail dated 10.07.2025 informed the DOE that a mail was sent to the Petitioner to provide the copies of SSC and MC meeting proceedings or issue letter to process her claim of switch from NPS to OPS, but the relevant documents weren't provided on the pretext that the same were 1 "NPS"2

2. The aforenoted SSC and MC refer to the Staff Selection Committee and the Managing Committee. The said documents are being insisted upon by Respondent No. 1 to substantiate and verify the Petitioner's appointment. However, such records, being in the nature of minutes, are ordinarily maintained by the Respondent School and cannot be expected to be in the possession of the Petitioner.
3. In view of the stand taken in the counter affidavit, there does not appear to be any substantial controversy requiring adjudication in the present petition. The impediment in processing the Petitioner's claim is essentially on account of non-furnishing of documents by the Respondent School authorities.
4. Accordingly, the petition is disposed of with a direction to the Respondent School to furnish all requisite documents, as sought by Respondent No. 1, for the purpose of processing the Petitioner's claim. In the event that the minutes of the SSC and MC are not available, the School shall furnish alternative records to establish and confirm the date of the Petitioner's appointment.
5. The aforesaid exercise be completed within a period of two weeks from today. Upon receipt of the documents, Respondent No. 1 shall process the Petitioner's request for switch from NPS to OPS within a further period of four weeks thereafter.
6. In view of the above, Mr. Vinit Trehan, counsel for the Petitioner, This is a digitally signed order.
