Section 18(1) in West Bengal Municipal Employees' (Classification, Control, Appeal and Conduct) Rules, 2010
(1)Notwithstanding anything contained in these rules the Board of Councillors, may, either on its own motion or otherwise, call for the records of any case and review any order which is made or is appealable under the rules and. may-(a)confirm, modify or set aside, the order:(b)confirm, reduce, enhance or set aside the penalty imposed by the order, or impose any penalty where no penalty has been imposed:(c)remit the case to the authority which made the order or to any other authority directing such authority to make such further enquiry as it may consider proper in the circumstances of the case; or(d)pass such other orders as it deems fit :Provided that no order imposing or enhancing a penalty shall be passed unless the person concerned has been given an opportunity of making any representation which he may wish to make against such penalty or enhanced penalty.
