JUSTICE NARENDRA KUMAR JAIN-II Mr. Harish Purohit) for the appellants Ms. Anjana Jawa ) <><><> These four intra-court appeals arising out of similar nature orders dated 22.10.2011 as passed by a learned Single Judge of this Court in different but similar nature writ petitions, are reported to be time-barred by about 170 days and carry a few more defects. However, while ignoring the other defects and even the question of limitation, these appeals are taken up for final disposal on merits by this common order for the reasons indicated infra.
The learned counsel for the appellants has frankly submitted that the issue involved in these appeals stands covered against the appellants in view of the judgment dated 07.12.2011 as passed by this Court in SAW No.796/2011: RSRTC & Anr. Vs. Shanker Lal & Ors.
The substance of the matter remains that the writ petitions leading to these appeals were filed by different persons, working on DBSAW No.550/2012 with four connected matters 2 the post of driver with the appellant-Corporation, on the grievance against denial of regular pay scale even after completion of three years in service.
The learned Single Judge disposed of the writ petitions with reference to the order dated 19.01.2011, as passed in CWP No.7682/2009: Shanker Lal & Ors. Vs. State of Rajasthan & Ors., whereby directions were given to grant regular pay scale as assured under the advertisement in question after completion of three years' satisfactory service. The aforesaid order dated 19.01.2011 was taken in appeal, being SAW No.796/2011, that was considered and dismissed by a co-ordinate Bench on 07.12.2011 after finding that the learned Single Judge was justified in allowing the writ petition.
In view of the above and particularly in view of the judgment dated 07.12.2011 in SAW No.796/2011, so far this Court is concerned, the matter stands concluded against the appellant- Corporation.
In view of the above, following the decision in SAW No.796/2011, these appeals also stand dismissed in the same terms.
