The instant bunch of intra-court appeals arises out of identical orders passed by learned Single Bench whereby, following the Division Bench judgment in the case of State of Rajasthan & Ors. vs. Poonam Sharma (D.B. Special Appeal (Writ) No.815/2019, decided on 29.08.2019), the learned Single Bench directed the appellant State to undertake the exercise as has been directed by the Division Bench in the case of Poonam Sharma (supra) as below:-
"The brief facts of the case are that Senior Teachers recruited under the 1971 Rules are, recruited and posted in 9 different divisions. Their inter se seniority is separately maintained on division-wise basis. Their transfer from one division to another entails loss of seniority, under the Rules. Consequently, allocation of divisions assumes some importance. The State Government through a specific policy- contained in its guide-lines of 04.03.2018, endeavored to introduce transparency in allocations of divisions; such exercise was to be determined on the basis of merit-cum- preference (having regard to the relative success) of the candidates in the recruitment process. This, of course, was subject to availability of vacancies in the respective divisions."
Learned AAG Shri Pankaj Sharma and Shri Rishi Soni representing the State submitted that the ratio of the Division Bench Judgment in the case of Poonam Sharma (supra) could not have been applied in the present controversy because the said (Downloaded on 31/08/2022 at 10:52:40 PM) (43 of 50) [SAW-477/2021] judgment arose out of a selection process relating to Teachers Grade-II whereas the present controversy relates to appointment and posting of Teachers Grade-III (Level-I & Level-II) and hence, the impugned orders are bad in the eyes of law. Shri Sharma urged that the respondents herein, after selection vide the initial select list were provided postings in accordance with their choice with reference to their position in the merit. Thereafter, reshuffling took place as many candidates did not turn up for document verification and others did not appear for joining. As a consequence of the above situation, litigation ensued and this Court, in the cases of Kuldeep Kumar & Ors. vs. State of Rajasthan & Ors. (SBCWP No.2094/2019) and Lokendra Singh & Ors. vs. State of Rajasthan (SBCWP No.1188/2020) directed the State to fill up the vacant posts by operating the category-wise reserve list and in compliance of the aforesaid directions, the State Government issued an order dated 18.12.2020 proposing to fill the vacant posts by issuing the waiting list from the existing merit position. Shri Sharma urged that the recruitment in the case of Poonam Sharma (supra) was for the post of Senior Teachers under the Rajasthan Education Subordinate Service Rules, 1971 whereas the recruitment in the cases at hand has been made under the Rajasthan Panchayati Raj Act, 1994 and Rajasthan Panchayati Raj Rules, 1996. He urged that there is a fundamental difference in the posts of Senior Teachers, Teachers Grade-II and the Teachers Grade-III because in the former cadre, the seniority is maintained division-wise whereas, in the case of Teachers Grade-III, the seniority is maintained district-wise. (D.B. Special Appeal (Writ) No.823/2018, decided on 09.08.2018 was referred to and finally, it was decided as below:-

Shri Sharma urged that if the directions given by the learned Single Bench are to be followed, the entire selection list would have to be re-shuffled which might lead to the disruption of a large number of candidates who have already settled on their respective posts and thus, the impugned orders deserve to be quashed and set aside.
Econverso, learned counsel Shri Tanwar Singh Rathore, Shri N.K. Sharma, Shri O.P. Kumawat, Shri O.P. Sangwa and Shri Abhishek Sharma representing the respondents vehemently and fervently opposed the submissions advanced by learned AAG, Shri Sharma. They contended that as per the applicable policy and the terms and conditions of recruitment, the successful candidates were to be provided posting with reference to their standing in the merit. At the initial stage of selection, the writ-petitioners herein were provided postings by operating the merit list. However, (Downloaded on 31/08/2022 at 10:52:40 PM) (48 of 50) [SAW-477/2021] subsequent operation of waiting list pursuant to the direction given by this Court, has resulted into a situation wherein, candidates lower in merit as compared to the writ-petitioners, have been given posting at places which the writ-petitioners would be entitled to hold as per their standing in the comprehensive merit list. They, thus, urged that the impugned orders deserve to be affirmed.
We have given our thoughtful consideration to the submissions advanced at bar and have gone through the impugned orders and the material placed on record.
At the outset, we may note here that while deciding the controversy, the learned Single Bench drew analogy from the judgment in the case of Poonam Sharma (supra) and extended the relief to the writ-petitioners herein. It is worthwhile to mention that the recruitment in the case of Poonam Sharma (supra) was made under the Rajasthan Education Subordinate Service Rules, 1971 for the post of Senior Teachers whereas, the cases at hand pertain to recruitment on the post of Teacher Grade-III (Level-I & Level-II) under the Rajasthan Panchayati Raj Act, 1994 and Rajasthan Panchayati Raj Rules, 1996. Thus, on the face of it, the ratio in the case of Poonam Sharma (supra) could not have been applied to the recruitment which was made under a different set of Rules. It is an admitted position that in the case of recruitment to the Teachers Grade-III, (Level-I & Level-II), the seniority lists are maintained district-wise. The State Government has taken a policy decision dated 25.02.2019 not to re-shuffle the seniority (Downloaded on 31/08/2022 at 10:52:40 PM) (49 of 50) [SAW-477/2021] lists more than once because if frequent process of re-shuffling is undertaken, the postings/districts of the previously selected candidates would be disturbed. This causes serious administrative difficulties inasmuch as fresh counselling is required to be undertaken in the new district and significant additional expenditure is incurred. The State Government has passed the direction No.3.1 (reproduced supra) that only one exercise of re- shuffling would be undertaken to fill the posts which remain vacant on account of non-joining of the candidates/rejection of the candidature of the candidates pursuant to the document verification. It has been decided that reshuffling would be undertaken by strict adherence to the Rules of reservation and thus, the position of the candidates who have already joined in pursuance of the first select list would not be disturbed. The candidates who are selected by operation of the waiting list would be offered postings against district-wise vacancies based on counselling and as per their choice.
We are of the firm view that this exercise can only be undertaken qua the candidates who have come into the zone of consideration owing to non-joining by successful candidates and exclusion of the candidates pursuant to document verification. The candidates who have been selected by operation of waiting list cannot be integrated into the original merit list while offering them the place of posting because such a course of action would lead to chaos, grave administrative difficulties and significant expenditure. Thus, the impugned orders passed by the learned Single Bench, accepting the writ petitions of the respondents on the basis of the (Downloaded on 31/08/2022 at 10:52:40 PM) (50 of 50) [SAW-477/2021] Division Bench Judgment in the case of Poonam Sharma (supra) are not sustainable in the eyes of law and are hence, reversed.
The intra-court appeals are allowed in these terms. No order as to costs.
