(5)If, in any case, any loss of life or property is caused, or is likely to be caused, by reason of any misconduct on the part of a technical person engaged under sub-section (1), such technical person shall be subject to the provisions of section 401A.]Explanation.- For the purposes of this section, the expression "technical person" shall mean a technical consultant.D.
