Section 197(3) in The U.P. Municipalities Act, 1916
(3)In deciding whether to exclude a house or building from the notice, the [Municipality] [Substituted by U.P. Act No. 12 of 1994.] shall consider, among other matters, the efficiency of the arrangements for house-scavenging made by the occupier.
